r) <br />2 <br />wcrvrmcT Al awT■ <br />ti k-& <br />888286 <br />DECLARATION OF PROTECTIVE. <br />COVENANTS AND RESTRICTIONS <br />VOL 276 DACE261 <br />WHEREAS the undersigned are the owners of all the lots <br />in Benz Plat, a subdivision in the Village of Sun Prairie, <br />Dane County, Wisconsin, and described as follows, to -wit: <br />Lots numbered One (1), Two (2), Three (3), Four (4), Five (5) <br />Six (6) Seven (7), Eight (8), Nine (9) Ten (10), Eleven (11), <br />Twelve (12), Thirteen (13), Fourteen (14), Fifteen (15), <br />Sixteen (16), Seventeen (17), Eighteen (18), Nineteen (19), <br />Twenty (20), Twenty -one (21), Twenty -two (22), Twenty -three <br />(23), Twenty -four (24), Twenty -five (25), Twenty -six (26), <br />Twenty -seven (27), Twenty -eight (28), Twenty -nine (29), <br />Thirty (30), Thirty -one (31), Thirty -two (32), Thirty -three <br />(33), Thirty -four (34), Thirty -five (35), Thirty -six (36), <br />Thirty -seven (37), Thirty -eight (38), Thirty -nine (39), <br />Forty (40), Forty -one (41), Forty -two (42), Forty -three (43), <br />Forty -four (44), Forty -five (45), Forty -six (46), Forty - <br />seven (47), Forty -eight (48), Forty -nine (49), and Fifty (50), <br />in Eenz Plat, a subdivision of part of the Northwest One - <br />Quarter (NW 1/4) of the Northeast One - Quarter (NE 1/4), of <br />Section numbered Five (5), Town Eight (8) North, of Range <br />Eleven (11) East, in the Village of Sun Prairie, Dane County, <br />o1isconsin, <br />and <br />v!HEREAS it,is deemed proper to impose upon the lots in <br />said subdivision certain restrictions, reservations, limit- <br />ations, and covenants hereinafter set forth for the benefit <br />and protection of the owners, present and future, of the lots <br />in said subdivision, <br />110W, THEREFORE, it is hereby declared and agreed that <br />the following restrictions, reservations, limitations and <br />covenants be and the same hereby are adopted and that all <br />lots in said subdivision shall be subject thereto as follows, <br />to -wit: <br />ARTICLE I <br />These covenants are to run with the land and shall be <br />binding on all parties and all persons claiming under them <br />until January 19, 1975, at which time said covenants shall <br />be automaticaliy extended for successive periods of 10 years <br />unless by vote of a majority of the then owners of the lots <br />it is agreed to change said covenants in whole or in part. <br />If the parties hereto, or any of them, or their heirs <br />or assigns, shall violate or attempt to violate any of the <br />covenants herein it shall be lawful for any other person <br />or persons owning any real property situated in said dev- <br />elopment or subdivision to prosecute any proceedings at <br />law or in equity against the person or persons violating or <br />attempting to violate any such covenant and either to pre- <br />vent him or them from so doing or to recover damages or <br />other dues for such violation. <br />Invalidation of any one of these covenants by judgment <br />or court order shall in no wise affect any of the other <br />provisions which shall remain in full force and effect. <br />
