Driscoll <br />734B Crawford Drive <br />Cottage Grove, Wisconsin 53527 <br />Re: # 081218390001 & # 081218388603 <br />SW1/4 S18 T8N R12E <br />Town of Medina <br />Dane County <br />Dear Mr. Driscoll: <br />Land Division Review <br />608/266-9086 <br />It is apparent that the subject land parcel, described in R25183/48, Dane County <br />Registry, was properly created as a separate single legal entity of 20.00 acres prior <br />to the effective date of the Dane County Land Division Regulations, and prior to the <br />effective date of A-1 Agriculture (Exclusive) Zoning in the Town of Medina. <br />Accordingly, this 20.00 acres parcel can be separately conveyed, at this time, <br />without a Dane County certified survey map approval, and without a change in <br />zoning classification, pursuant to S.10.16(3)(a), Dane County Code of Ordinances. <br />Any division of this 20.00 acres will require a Dane County certified survey map <br />approval, together with a change in zoning classification. <br />Two separate tax parcels exist because the 20.00 acres is described within two <br />distinct 40 acre tracts. Tax description does not create separate legal parcel status. <br />S.10.04(1), Dane County Code of Ordinances provides that only one residence is <br />permitted on a single parcel of record. The subject 20.00 acres parcel must be <br />divided in order to construct a second single family residence.
