It is apparent that the subject 1.989 acres land parcel, described in <br />Document # 3883264, Dane County Registry, was properly created as a separate <br />legal entity in accordance with the provisions of the Dane County Land Division <br />Regulations. Accordingly, this 1.989 acres parcel can be separately conveyed, at this <br />time, without a further Dane County certified survey map approval. <br />The proposal to attach 1.31 acres to this parcel can be accomplished without further <br />Dane County approvals, pursuant to S.236.45(2)(a)3., Wisconsin Statutes. <br />However, the boundaries of Lot 3, Certified Survey Map # 10411 are not vacated <br />and discontinued by the mere recording of a warranty deed, and will continue to <br />exist in the public record. These boundaries must be respected for the purposes of <br />building setback. The certified survey map lot boundaries are properly vacated and <br />discontinued with the recording of a new certified survey map, which would <br />describe the consolidated 3.299 acres parcel. <br />Thank you for your anticipated patience and for your anticipated cooperation in <br />this matter. <br />Sincerely, <br />Norbert Scribner, Land Division Review <br />cc: Howard C.
