Dane County Planning & Development
Room 116, City -County Building, Madison, Wisconsin 53709 Land Division Review
608/266-9086
April 12, 2002
Kurt Nowka
113 North Second Street
Mount Horeb, Wisconsin 53572
Re: # 050617480405
SE1/4 S17 T5N R6E
Town of Perry
Dane County
Gentlepeople:
It is apparent that the subject land parcel is divided by County Trunk Highway A.
Accordingly, the several acres, located North of County Trunk Highway A (note
enclosure), is a valid legal parcel of record with respect to the provisions of the Dane
County Land Division Regulations, and can be separately conveyed, at this time,
without a Dane County certified survey map approval.
However, the current Dane County interpretation of a zoning parcel provides that
all lands within the same ownership, even though they may consist of non-
contiguous elements, are considered to be a single zoning parcel with respect to the
provisions of the Dane County Zoning Ordinance. Accordingly, any division of the
25.300 acres, described by # 050617480405, will require a change in zoning
classification.
The minimum building setback from the County Trunk Highway A right-of-way
boundary is 42'.
Sincerely,
Norbert Scribner, Land Division Review
cc: Elwood J. Nowka
Clerk, Town of Perry
Dane County Highway Department
Enclosure:
