It is apparent that the subject 1.52 acres land parcel, described in <br />Document # 4099408, Dane County Registry, was created as a separate legal entity <br />without a Dane County certified survey map approval. However, it is also apparent <br />that this parcel may have resulted from a decision of the Circuit Court, Dane <br />County Case No. 06-CV-584. <br />S.236.45(2)1., Wisconsin Statutes provides "a local subdivision ordinance shall not <br />apply to transfers of interests in land by will or pursuant to court order." If <br />S.236.45(2)1., Wisconsin Statutes is applicable to the subject parcel creation, it <br />would not be appropriate for Dane County to designate # 050606495700 an "illegal" <br />parcel. However, if S.236.45(2)1., Wisconsin Statutes is not applicable, a Dane <br />County certified survey map approval would be required to correct this parcel <br />status.
