Parkos: <br />As directed by your communication of March 15, 2002, received on March 19, 2002, <br />my immediate attention is described as follows: <br />Pursuant to a Wisconsin Attorney General opinion, and in accordance with several <br />court decisions, it is the consistent position of Dane County that lands divided by a <br />public highway shall be considered as separate and distinct with respect to the <br />provisions of the Dane County Land Division Regulations. Accordingly, the subject <br />lands, located North of State Trunk Highway 78, can be separately conveyed, at this <br />time, without a Dane County approval of a certified survey map (please note that it <br />is apparent that the Town of Perry has adopted a Land Division Regulation, and it <br />is possible that the Town does not recognize the referenced Wisconsin Attorney <br />General opinion or the related court decisions). <br />The current Dane County interpretation of a zoning parcel provides that all lands <br />within the same ownership, even though they may include non-contiguous elements, <br />constitute a single zoning parcel. Accordingly, the subject lands, located North of <br />State Trunk Highway 78, cannot be separated from the balance of your ownership <br />without a change in zoning classification.
