Dane County Planning & Development <br />Room 116, City -County Building, Madison, Wisconsin 53703-3342 <br />January 13, 2006 <br />Donna Vogel, Clerk, Town of Pleasant Springs <br />2354 Highway N <br />Stoughton, Wisconsin 53589-2873 <br />Re: River Estates Lane <br />NW/4 S28 T6N R11E <br />Town of Pleasant Springs <br />Dane County <br />Dear Donna: <br />As requested, I have completed a search of the public record in an effort to <br />determine the legal status of River Estates Lane. <br />Land Division Review <br />608/266-9086 <br />It is apparent that on 04/08/68 Lauren Havey, Marietta Havey, Alfred E. Havey <br />& Evelyn Havey recorded a quit claim deed conveying River Estates Lane to the <br />Town of Pleasant Springs. However, the document recorded in R19/530, Dane <br />County Registry, does not include, or reference, a formal acceptance by the Town of <br />Pleasant Springs. Wisconsin Case Law has often supported the proposition that a <br />public highway status is not correctly established by merely recording a deed in the <br />name of a municipality. <br />The Town of Pleasant Springs would be well advised to obtain the advice of legal <br />counsel in this matter. <br />Sincerely, <br />Norbert Scribner, Land Division Review <br />Enclosure: <br />
