<br />I. <br /> <br />The owner or potential purchaser of any lot s bject to these conditions, <br />covenants, restrictions and easements seeking a proval of the Architectural <br />Control Committee shall complete such applicat; form as specified by the <br />Architectural Control Committee (which appli tion form shall require <br />specification of the details as specified in paragrap J below), submit Two (2) <br />sets of plans for which approval is sought and shall ay the required plan review <br />fee as specified by the Architectural Control Co mittee. The Architectural <br />Control Committee shall act on said complete appli tion (including application <br />form, complete plans and the payment of the plan rtiew fee) within fifteen (15) <br />business days of complete submission (whether by approval, conditional <br />approval or disapproval), unless the time for de . sion is extended by the <br />Committee. Any disapproval shall specify the reaso~s for disapproval. All action <br />by the Architectural Control Committee must be in ~iting to be effective. Oral <br />approvals of whatever kind are null and void. . <br /> <br />In deciding whether to approve or disapprove SUbm~ed application and plans. <br />the Architedural Control Committee shall consider an pay particular attention to <br />exterior design including exterior elevations, baseme t materials, siding, number <br />of windows and window size and location, trim, roof, pitch and material, soffits, <br />fascia, minimum floor areas, landscaping, quality of aterials and workmanship, <br />and location and plan aesthetics, including color, in relation to surrounding <br />structures, landscaping, street and adjacent structu e and lot finished grades, <br />and topography. All colors, whether for trim, si ing, or roofing, shall be <br />coordinated to provide for the most aesthetic co bination for a particular <br />structure as well as for the overall development of Ithe lots. The Architectural <br />Control Committee shall avoid repetitive design ofsadjacent or nearby single <br />family homes. The overall color scheme must be ubmitted with the building <br />plans for approval. Conditional approval may be gitn for contemplated single <br />family detached dwelling plans or designs and othe structures submitted by a <br />person considering the purchase of a lot. The Archi ectural Control Committee <br />has sole and unlimited discretion of approval, conditional approval or <br />disapproval, in good faith exercised, including the rig t to provide for exceptions <br />as it deems necessary and proper. No changes or de iations may be made in or <br />from such approved plans and specifications, nor cha ges or modifications to the <br />exterior appearance of any existing structures incJ ding, but not limited to, <br />exterior remodeling, repainting or staining, or constr~dion of patios, decks, or <br />swimming pools, shall be made without the prior ap roval of the Architectural <br />Control Committee. Approval of such plans does no constitute a warrantee or <br />representation that such plans are structurally sound r that the plans meet city, <br />county or state codes, same being the responsibility 0 the owner(s) and his, her, <br />or their builder. The owner(s) agree to hold the Archi ectural Control Committee <br />harmless from any and all claims that may arise om the exercise of their <br />discretion in approving or disapproving any request, 0 from approving subject to <br />conditions any request and with respect to design, nstruction and materials <br />used in the structure and claims relating to any all ed abuse of the sole and <br />unlimited discretion of the Architectural Control Commi ee. <br /> <br />J. <br />
