FIFTH AMENDMENT TO DECLARATION OF PROTECTIVE COVENANTS, <br /> RESTRICTIONS AND CONDITIONS <br /> This Fifth Amendment to Declaration of Protective Covenants, Restrictions and <br /> Conditions for the Plat of Rivers Turn (the "Fifth Amendment") is made and executed as <br /> of this 3rd day of October, 2014 by Rivers Turn, LLC, (the"Developer.") <br /> RECITALS <br /> WHEREAS, the Developer executed and declared certain Declaration of <br /> Protective Covenants, Restrictions and Conditions for the Plat of Rivers Turn dated as of <br /> July 19th, 2007 and recorded with the Dane County Register of Deeds as Document No. <br /> 4335370 on July 19th, 2007(the"Restrictions and Covenants"); <br /> WHEREAS, the Developer executed and declared the First Amendment to <br /> Declaration of Protective Covenants, Restrictions and Conditions for the Plat of Rivers <br /> Turn, in the Village of Deforest, Dane County, Wisconsin dated as of December 3rd, 2012 <br /> and recorded with the Dane County Register of Deeds as Document No. 4938768 on <br /> December 5th, 2012 (the"First Amendment"). <br /> WHEREAS, the Developer executed and declared the Second Amendment to <br /> Declaration of Protective Covenants, Restrictions and Conditions for the Plat of Rivers <br /> Turn, in the Village of Deforest, Dane County, Wisconsin dated as of February 22", <br /> 2013 and recorded with the Dane County Register of Deeds as Document No. 4963959 <br /> on February 22"d, 2013 (the"Second Amendment"). <br /> WHEREAS, the Developer executed and declared the Third Amendment to <br /> Declaration of Protective Covenants, Restrictions and Conditions for the Plat of Rivers <br /> Turn, in the Village of Deforest, Dane County, Wisconsin dated as of July 2"d, 2013 and <br /> recorded with the Dane County Register of Deeds as Document No. 5003831 on July 8th, <br /> 2013, which were incorrectly identified as the "Second Amendment" is such document <br /> (the"Third Amendment"). <br /> WHEREAS, the Developer executed and declared the Fourth Amendment to <br /> Declaration of Protective Covenants, Restrictions and Conditions for the Plat of Rivers <br /> Turn, in the Village of Deforest, Dane County, Wisconsin dated as of November 21st, <br /> 2013 and recorded with the Dane County Register of Deeds as Document No. 5039478 <br /> on November 20,2013 (the"Fourth Amendment"). <br /> WHEREAS, the Developer executed and declared the Declaration of Association <br /> of Conservancy Place Community Association, Inc. governing the lots in the Plat of <br /> Rivers Turn dated as of November 11, 2004 and recorded with the Dane County Register <br /> of Deeds as Document No. 3992703 on November 11, 2004 (the "Association <br /> Declaration") <br />
