This request is for an area covering 19 acres for a period of 10 years. <br /> <br />Analysis <br />Surrounding Area Characteristics: The remainder of the Norslien parcel (west of CUP) is zoned C- <br />2. The surrounding area also includes agricultural land, and scattered residential and commercial <br />land uses. <br /> <br />Operational Plans: The applicant provided the following description of the operation: <br /> <br />"The quarry will be used to produce aggregate products for various purposes, including but not <br />limited to, construction of buildings and roads, agricultural uses, and DOT projects". <br /> <br />The operation will involve removing topsoil and overburden, drilling and blasting, crushing, <br />stockpiling of crushed rock, and loading and hauling. Notification of blasting will be given prior to <br />blasting to all surrounding neighbors who wish to be notified. Frequency of drilling, blasting and <br />crushing is expected to be from 4 to 6 times per year. Hours of operation will be will from 6:00 a.m. <br />to 6:00 p.m. Monday through Friday, and 6:00 a.m. to 2:00 p.m. on Saturday. <br /> <br />Town of Vermont Comprehensive Plan: <br /> <br />The subject property is located in the "Rural Preservation Area" of the town land use map. <br /> <br />Compliance with County Ordinances: Mineral extraction operations must meet requirements found <br />in Chapters 10, 14 and 74 of the Dane County Code of Ordinances. The applicant has submitted an <br />erosion control plan/storm water management plan as required by Chapter 14, and a reclamation <br />plan as required by Chapter 74, of the Dane County Code of Ordinances (DCCO). Section <br />10.12(3)(a) Conditional uses permitted in the A-l Agriculture District lists "Mineral extraction <br />operations, asphalt plants, ready mix concrete plants". Chapter 1 0 provides six standards for <br />granting a CUP in Section lO.255(2)(h) of the zoning ordinance. They are as follows: <br /> <br />1. That the establishment, maintenance, or operation of the conditional use will not be <br />detrimental to or endanger the public health, safety, comfort or welfare. <br /> <br />2. That the uses, values and enjoyment of other property in the neighborhood for purposes <br />already permitted shall be in no foreseeable manner substantially impaired or <br />diminished by establishment, maintenance or operation of the conditional use. <br /> <br />3. That the establishment of the conditional use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br /> <br />4. That adequate utilities, access roads, drainage and other necessary site improvements <br />have been or are being made. <br /> <br />5. That adequate measures have been or will be being taken to provide ingress and egress <br />so designed as to minimize traffic congestion in the public streets; and <br /> <br />6.
