A copy of the required reclamation plan shall be filed with both the Town of <br />Vermont and the Dane County Zoning Division. <br /> <br />State approval of NR 135 is anticipated sometime in 2000. Following state approval, counties will <br />be required to update their ordinances accordingly. <br /> <br />To ensure compliance with the reclamation plan, the operator shall post and maintain a <br />bond or irrevocable letter of credit in favor of Dane County in the amount of $15,000 <br />($1,500 per acre of disturbed area up to a maximum of 1 0 acres) until reclamation is <br />satisfactorily completed. <br /> <br />Once NR 135 is passed, it will likely include a similar requirement for reclamation <br />bonding. If possible under State requirements, this County bonding requirement <br />shall count toward whatever bonding is required by the State. The intent here is to <br />avoid double counting any reclamation bonding. <br /> <br />The driveway accessing the subject site shall be paved. The operator shall maintain the <br />driveway in a dust free manner in accordance with local, state, and federal regulations, and <br />shall clean any dust or mud tracked onto public roads. <br /> <br />The operator and all haulers shall access the CUP site only through the existing access <br />point via the Norske Wood Products property and indicated on Attachment A and on the <br />"Proposed Site and Reclamation Plan" dated April, 2000. <br /> <br />The access to the driveway shall have gates securely locked when the extraction site is not <br />in operation. The site shall be signed "NO TRESPASSING." <br /> <br />Hours of operation shall be from 6 a.m. to 6 p.m., Monday through Friday. Saturday <br />operations shall be from 6:00 a.m. to 2:00 p.m. No operations of any kind shall take place <br />on Sundays or legal holidays. <br /> <br />The operator shall comply with Subchapter VII, Blasting Resultants, of the State of <br />Wisconsin Department of Commerce Administrative Code. In particular, blasting levels <br />shall be kept below 0.5 inch/second peak particle velocity at frequencies below 40 Hz., as <br />. per the State of Wisconsin Department of Commerce Administrative Code, s. 7.64, Table <br />7.64-2. <br /> <br />8. <br /> <br />9. <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />The operator shall keep on file a seismographic record for every blast: This record shall <br />be provided upon request. <br /> <br />There shall be a safety fence around the entire extraction area at all times, as per the <br />agreement between Yahara Materials Inc. and surrounding property owners. This fence <br />shall be comprised of a basic barbed wire. farm fence with posts and "NO <br />TRESP AS SING" signs at regular intervals around the entire perimeter of the anticipated <br />disturbed area. <br /> <br />The operator shall use water spray bars in the crushing process to reduce dust. Use of <br />spray bars is not required when the temperature is below freezing. The operator shall <br />spray the site with water if and when needed to control dust. <br /> <br />There shall be no bulk fuel stored on site. In cases where the operator wishes to have bulk <br />fuel stored on site, the operator should indicate why and provide and receive approval <br /> <br />15. <br /> <br />16. <br />
