<br />6. The excavation/removal of minerals or gravel shall be prohibited within 10 feet of the <br />boundaries of the conditional use permit. <br /> <br />7. All highwalls exceeding 40 feet in height shall be benched at the top of the wall as <br />depicted on the attached benching plan dated June 11, 2010. The bench shall be 10-foot <br />horizontal with a maximum of a 10-foot vertical drop. Benching shall be installed when the <br />mineral extraction operation comes within 20 feet of the conditional use permit <br />boundaries. <br /> <br />8. Reclamation shall be completed within one year after operations have ceased, and shall <br />follow the operator's submitted reclamation plan. <br /> <br />9. Reclamation shall meet requirements of Chapter 74 of the Dane County Code of <br />Ordinances. <br /> <br />10. The driveway accessing the subject site shall be paved. The operator shall maintain the <br />driveway in a dust free manner in accordance with local, state, and federal regulations, and <br />shall clean any dust or mud tracked onto public roads. <br /> <br />11. The operator and all haulers shall access the CUP site only through the existing access <br />point via the Norske Wood Products property. <br /> <br />12. The all access drives to the mineral extraction site shall have a gate securely locked when <br />the extraction site is not in operation. The gate shall be posted with a sign designating <br />"NO TRESPASSING." <br /> <br />13. Hours of operation shall be from 6 a.m. to 6 p.m" Monday through Friday. Saturday <br />operations shall be from 6:00 a.m. to 2:00 p.m. No operations of any kind shall take place <br />on Sundays or legal holidays. <br /> <br />14. The operator shall comply with Subchapter VII, Blasting Resultants, of the State of <br />Wisconsin Department of Commerce Administrative Code. In particular, blasting levels <br />shall be kept below 0.5 inch/second peak particle velocity at frequencies below 40 Hz., as <br />per the State of Wisconsin Department of Commerce Administrative Code, s. 7.64, Table <br />7.64-2. <br /> <br />15. The operator shall keep on file a seismographic record for every blast: This record shall <br />be provided upon request. <br /> <br />16. A continuous (five) 5-foot tall woven metal fencing shall be installed as designated on the <br />attached operations plan dated June 11, 2010. The fencing shall be installed within 60 <br />days of effective date of this conditional use permit. "No Trespassing" signs shall be <br />placed every one hundred (100) feet along the fencing. <br /> <br />17. The operator shall use water spray bars in the crushing process to reduce dust. Use of <br />spray bars is not required when the temperature is below freezing. The operator shall <br />spray the site with water if and when needed to control dust. <br /> <br />18. There shall be no bulk fuel stored on site. In cases where the operator wishes to have <br />bulk fuel stored on site, the operator should indicate why and provide and receive <br />approval from the Dane County Land Conservation Department of a spill containment plan <br />that meets state regulations prior to storing bulk fuel on the site. <br /> <br />19. All excavation equipment, plants, and vehicles shall be fueled, stored, serviced, and <br />repaired on lands three (3) feet above highest water table elevation to prevent against <br />groundwater contamination from leaks or spills. <br /> <br />H:\Zoning\ZLR\Conditional Use Permits\CUP #2135.doc <br /> <br />Page 2 of 5 <br />
