legitimate complaint and public hearing, that the operator has violated the permit"
(paraphrased). There is a reclamation permit (Chapter 74 permit No. 74-60)
associated with the mineral extraction operation.
. Shoreland/Floodzone/Wetlands: None
. Asphalt plant CUP's in the A-lEX district may be granted only "for
production of material to be used in construction of public roads, to be limited
in time to project duration" as per Section 1 0.123(3)G) DCCO.
2. CUP applications always require a complete site plan. This was not included
in the detailed application materials for CUP 1962. Dane County Zoning
needs a site plan showing the area in which the portable asphalt plant would
be located and relocated during the 25-year CUP period (not each specific
location) along with any existing or proposed associated structures, parking
and loading areas, driveways, haul roads, etc.
(Questions? The goal of this district is to "preserve productive agricultural lands in the
long-term" .
. Surrounding uses: The subject proposal will be located within an existing active
quarry. Asphalt plants are commonly located within existing quarries. Some obvious
reasons for this include: ready access to material, use of existing transportation routes,
and preexisting screening provided by high walls and screening features already
existing for the mineral extraction site. Although the majority of the site is
surrounded by agricultural uses, there are two rural residential neighborhoods located
within the same section of the town. One is composed of the Shamrock Glen
Subdivision (and its first addition), plus three CSMs that add up to approximately 34
lots. To the south, across Greenbriar Road, is the Cherry Hill Subdivison, containing
20 lots. South of Cherry Hill, between Cherry Hill and the City of Middleton, is a
non-conforming (NC) mineral extraction site (registered under County Zoning
regulations in 1969). All of these uses are located in close proximity to the Hwy 12
corridor.
. (Questions? Contact Pam Andros - 261-9780)

TOWN ACTION REpORT
