<br />Surrounding Area Characteristics: The majority of the surrounding land uses are agricultural, and there are <br />two rural residential subdivisions located in the same section of the town. One is composed of the <br />Shamrock Glen Subdivision (and its first addition), plus three CSMs that add up to approximately 34 lots. <br />To the south, across Greenbriar Road, is the Cherry Hill Subdivison, containing 20 lots. South of Cherry <br />Hill, between Cherry Hill and the City of Middleton, is a non-conforming (NC) mineral extraction site <br />(registered under County Zoning regulations in 1969). All of these uses are located in close proximity to the <br />Hwy 12 corridor. <br /> <br />Town Plan: <br /> <br />Town of Springfield Comprehensive Plan: The subject property is located in the Agricultural <br />Preservation district. The objective of this district is to "Preserve productive agricultural lands in the <br />long-term". This district allows "limited commercial, and institutional uses", utilizes a residential <br />density policy of one/35 acres, and allows mineral extraction operations as conditional uses. <br /> <br />Compliance with County Ordinances: Per Section 10. 126(3)(a), concrete plants are allowed as a conditional <br />use in the A-2 district. Chapter 10 provides six standards for granting a CUP in Section 10.255(2)(h) of the <br />zoning ordinance are as follows: <br /> <br />1. That the establishment, maintenance, or operation of the conditional use will not be <br />detrimental to or endanger the public health, safety, comfort or welfare. <br /> <br />2. That the uses, values and enjoyment of other property in the neighborhood for purposes <br />already permitted shall be in no foreseeable manner substantially impaired or diminished by <br />establishment, maintenance or operation of the conditional use. <br /> <br />3. That the establishment of the conditional use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the district. <br /> <br />4. That adequate utilities, access roads, drainage and other necessary site improvements have <br />been or are being made. <br /> <br />5. That adequate measures have been or will be being taken to provide ingress and egress so <br />designed as to minimize traffic congestion in the public streets; and <br /> <br />6. That the conditional use shall conform to all applicable regulations of the district in which it is <br />located. <br /> <br />STAFF COMMENTS AND RECOMMENDED CONDITIONS <br />More information: The applicant needs to provide an updated legal description for the CUP area. The <br />description should match the 10 acre A-2 area. The applicant also needs to provide an updated site plan that <br />will show features of the operation including haul road, washing plant, an example footprint of a portable <br />concrete batch plant, and any other information that will be helpful in providing a.visual description of the <br />proposal. Staff has been in communication with the applicant and they will provide such information by <br />July 21 st. <br />Conditions: The ZLR Committee should condition approval on a combination of standard conditions listed <br />below combined with conditions proposed by the town.
