<br />the County cannot approve a plat within this area. The Southdale Neighborhood <br /> <br /> <br />Plan is currently being developed by the City of Fitchburg and the Town of <br /> <br /> <br />Madison to cover an area within the the City of Fitchburg's exterritorial platting <br /> <br /> <br />jurisdiction. The lands within the Novation Campus II plat are within this area. <br /> <br /> <br />The City of Fitchburg and the Town, which have concurrent platting <br /> <br />jurisdiction, have both approved the preliminary plat. <br />The City of Fitchburg and the Town have entered into a boundary <br /> <br />agreement under which the Novation Campus II lands will eventually be attached <br /> <br />to the City of Fitchburg. <br />In reviewing the criteria set forth in the Wisconsin Statutes and the Dane <br /> <br />County Ordinances for rejecting plats, we do not find final approval of the <br /> <br /> <br />Southdale Neighborhood Plan to be an allowable precondition to approval of a <br /> <br /> <br />plat. Furthermore, we find that the preliminary plat complies with the Dane <br /> <br /> <br />County Comprehensive Plan. <br /> <br />THE LAW <br />Chapter 236. Wis.
