9Foth Staff Report <br /> Commons, LLC have been presented by the petitioner over the years; however, no formal action has <br /> been taking by the Town Plan Commission or Town Board. <br /> The proposed site plan includes the following: <br /> 1. One 8-unit residential building on Lot 1 west of Scattergood Lane; <br /> 2. Two 8-unit residential buildings on Lot 3 east of Scattergood Lane; <br /> 3. 3,100sf for a stormwater detention facility on Lot 3;and <br /> 4. 18,900sf of open space(grass)on Lot 3. <br /> The proposed residential buildings will be marketed as rental units at this time; however, the recorded <br /> Condominium Documents allow for the expansion of this Phase if/and when the market can support <br /> owner occupancy of the units. <br /> In addition to requesting a Site Plan Review for the continuation of Windsor Commons, LLC, the <br /> petitioner will be requesting discussion and action by the Town Plan Commission and Town Board in <br /> May for the subdivision of Lot 3 into two Lots. The Town of Windsor was not able to notice the public <br /> hearing in time for the April meetings. ***Planner Note: The petitioner does not intend to proceed with <br /> the subdivision of Lot 3.*** <br /> TOWN POLICY CONCERNS/ISSUES: <br /> Following my review of the petitioner's application, I provide the Town of Windsor Plan Commission <br /> with the following policy concerns/issues: <br /> 1. The driveway accesses to the residential units fronting the railroad are dead ends without a <br /> turnaround area for larger vehicles. It is the opinion of the Town Planner that the proposed access <br /> plan be reviewed and approved by the Dane County Sheriff and the DeForest Fire and EMS agencies <br /> for emergency service access. ***Planner Note: The petitioner presented the Site Plan to the Dane <br /> County Sheriff and the DeForest Fire & EMS. Documentation of approval by each agency is enclosed <br /> with this staff report.*** <br /> 2. The proposed site plan identifies an existing 26'wide private access easement (CSM 10322, Doc. No. <br /> 3447342) serving Lots 1-3. However, the new driveway access for the proposed condominium <br /> buildings does not follow the existing easement. It is the opinion of the Town Planner that the <br /> existing 26' wide private access easement be amended to match the intent of the site plan. <br /> ***Planner Note: The petitioner has addressed the concern/issue in the revised Site Plan.*** <br /> 3. Lot 1 of CSM 10322 has an existing building on the south end. At this time the future (re)use of this <br /> building is unknown. Also, it is unknown if the re(use) of the subject building is addressed in Dane <br /> County's Conditional Use Permit#1545.
