13. The Department of Transportation reserves the right to inspect the parcel on site for sale purposes with
<br /> 24 hour or more notice to TENANT.
<br /> 14. The TENANT shall pay the rent in the amount of $100.00 per year to Wisconsin Department of
<br /> Transportation at the commencement of the lease.
<br /> 15. If Lessee fails to pay rent within 30 days of the due date hereunder, the monthly portion of such unpaid
<br /> amount shall be subject to a 5%delinquency fee for each month which it remains unpaid.
<br /> 10, in the event both parties agree to continue this lease after September 30, 2018, this agreement can be
<br /> renewed up to another 5 years depending on OWNER'S needs at that time. TENANT shall pay OWNER
<br /> annual rent on or before October 1,each year.

<br /> 17. No signs, display, billboards, or structures (other than the 6-post structure with picnic tables) of any type
<br /> shall be erected or changed on the above-described leased DOT lands except as approved by the
<br /> Department of Transportation.
<br /> 18. Lessee agrees NOT to use herbicides on land owned by WISDOT. **List of herbicides is attached.
<br /> 19. indemrnification and insurance
<br /> A. The TENANT shall pay, indemnify, and save harmless the STATE, its officials, officers, agents
<br /> and employees and assigns, from all suits, actions, claims, demands, damages, losses, and other
<br /> reasonable expenses and costs of every kind and description (except those proximately resulting
<br /> from or growing out of (1) acts of commission or omission, involving negligence or fault on the
<br /> part of the STATE or its employees or agents) to which the STATE or its employees or agents
<br /> may be subjected by reason of injury(including death) to persons or damage to property resulting
<br /> from or growing out of any act of commission or omission by the TENANT, its agents, or
<br /> employees or its contractors or subcontractors In connection with construction, reconstruction,
<br /> installation, development or removal work, service or operation being undertaken or performed by
<br /> or for the TENANT in, on, or over the teased premises, or(2) any use, occupancy or operation of
<br /> the premises, whether such suits, actions, claims, demands, damage, losses, expenses and
<br /> costs be against, suffered or sustained by the STATE, its agents or employees, or by other
<br /> persons, corporations or legal entitles to whom the STATE or its agents and employees may be
<br /> liable.
<br /> B. The TENANT shall secure and maintain or cause to be secured and maintained in full force and
<br /> effect, such comprehensive general public liability insurance covering Its liability under this
<br /> AGREEMENT and protecting the STATE, its officials, officers, agents and employees and
<br /> assigns, from any and all claims for personal Injuries or death or property damage which may
<br /> arise out of or in connection with the use and occupancy of the property, or occupancy of the
<br /> property, or of any improvements or installations, in or upon the same, or the performance of any
<br /> work or operations by the TENANT or its contractors or subcontractors, or anyone directly or
<br /> indirectly employed by any of them, or which may be occasioned by reason of use of the leased
<br /> premises.
<br /> C. The insurance requirements may be satisfied either through primary insurance coverage or
<br /> through excess/umbrella policies.
