NOTICE OF APPEAL <br /> DANE COUNTY BOARD OF ADJUSTMENT <br /> ✓ (I) (WE) Midland Builders , Inc. <br /> hereby appeal to the Dane <br /> County Board of Adjustment for a variance from _ side yard requirements of the <br /> Dane County Zoning Ordinance <br /> on the following described land Lot 25, Western Hills <br /> in <br /> the Town of Fitchburg which is located in the R-2 <br /> Residential Zoning District. <br /> The permit was denied because 10.06 (6)(a) of the Dane County Zoning Ordinance <br /> requires that minimum side yard shall be 10' <br /> The proposed building, addition or alteration will provide single family <br /> residence <br /> ✓ Strict application of the provisions of the ordinance would produce undue hardship <br /> because as an error was made in pouring the basement of approximately <br /> 3" , and this error was not caught until the home was completed, it is <br /> impossible to rectify, as we cannot move the house.
