Klinkner, Patrick
From: Lisa Zenz [Izenz @gcionline.com]
Sent: Wednesday, September 23, 2009 7:51 PM
To: Schutte, Kristine
Cc: Lane, Roger; Klinkner, Patrick; Shore, Ryan; Everson, Daniel
Subject: RE: Kerry Zenz shed documents/photos
Hello Kristine,
We chose to relocate the proposed building site so that it would be more than 85 feet from the
top of the stream bank. Before we could submit the new proposed site, Ryan Shore sent us an
email informing us that any land disturbing the shoreland zone (within 300 feet of a mapped
navigable waterway) requires an erosion permit. We contacted the DNR office of Dane County
and spoke to Cami Peterson. She informed us they do not charge for making the
determination regarding a navigable waterway. Upon her request, we sent photos of the
navigable waterway in question, the 1998 Navigability Determination and your photo of the
stream showing it as navigable. Please see her response below:
Lisa and Kerry,
The definition of navigable for DNR regulations is defined bed and bank and capable of floating a small
watercraft on a re-occurring basis at least once a year. The photos you provided do not show any
evidence of a defined bed and bank, so based on my desk top review I would say the waterway is not
navigable.
Cami Peterson
Water Management Specialist
South Central Region
Wisconsin Department of Natural Resources
(sr)phone: (608) 275-3208
(It)fax: (608) 275-3338
(C7)e-mail: cami.peterson@wisconsin.gov
Upon changing the location of the proposed shed, we also changed the floor plan so the
building will be higher. With the new location, the driveway will now be much shorter. Before
finalizing and contacting the builder again, we would like to get the current above issues
resolved so we can proceed with our building project.
Mr. Shore also indicated in an email that our proposed shed does not meet the definition of
agriculture. The proposed shed will be used for storing farm equipment for harvesting hay.
Thank you for being so patient with this project.
Kerry and Lisa Zenz
From: Schutte, Kristine [mailto:Schutte @co.dane.wi.us]
Sent: Tuesday, September 01, 2009 1:30 PM
To: Lisa Zenz
9/24/2009
