COMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> ZONING REVIEW <br /> 26. 7440 Heidi Stiller&Allan Bachmann and Bachmann Building Partnership (Thom <br /> Grenlie and Marilyn Dreger,agents),Verona 04 <br /> A-1EX to RH-3 and R-4 <br /> Stiller&Bachmann wish to create a 15 acre SFR/farmette parcel with frontage on Woods Road, on <br /> which to build their new home. Under the name of Bachmann Building Partner-ship,they also own <br /> the adjoining 20.878 acres with frontage on Mid-Town Road. The two parcels were divided without <br /> the required CSM, according to Norb Scribner, so rezoning and a Certified Survey Map are required. <br /> The 20.9 acre parcel has `grandfathered' multi-family residential uses,including: <br /> 1. An older farmhouse converted to(3)apartments; <br /> 2. A 4-townhouse unit apartment building; <br /> 3. An 30'x104' 8-stall garage; <br /> 4. A 16'x22' "laundry building"; and <br /> 5. A 26'x40' barn,which is 26' high. <br /> Stiller&Bachmann wish to bring the existing uses into compliance by rezoning to R-4 Multi-Family <br /> Residential and recording this parcel as a lot in a CSM. However, the R-4 District limits the uses of <br /> accessory buildings to"uses and buildings, clearly incidental and necessary to permit use on the <br /> premises"(DCCO Sections 10.08(1)(a)and 10.05(1)(d)), so the use of the barn is in question. In <br /> addition,the area and height of accessory buildings in the R-4 district is limited to: <br /> • Area: Total floor area of the accessory buildings may not exceed total floor area of the residential <br /> buildings; and <br /> • Height: May not exceed 12' "average height"(average of peak and eave height.) <br /> Both of these limits appear to have been exceeded;therefore, one or more Variances would be required <br /> to permit rezoning to the R-4 District and the recording of the CSM. <br /> Note: Previous Pet 7037(09/23/1997 ZNR Comm. P.H.)to rezone a 15 acre parcel from A-1EX to <br /> RH-3, and to rezone a to a 20.83 acre parcel from A-1EX to R-4(0.6 acres)for the two apartment <br /> buildings and A-2 (20.2 acres)for the outbuildings and remaining land, was approved subject to a <br /> Deed Restriction"that there shall be no further residential development on the A-2 and R-4 rezone <br /> areas." However,no CSM was recorded because the City of Madison(Corporate Limits 0.3 miles <br /> from A-2 parcel)would not approve the CSM, so the Petition became void. <br /> REGIONAL PLANNING <br /> Petition 7440. A similar petition was reviewed for this site(Petition 7037,Public Hearing 9/23/97).It <br /> was subsequently approved with the condition"that there shall be no further residential development on <br /> the A-2 and R-4 rezone areas."No CSM was recorded and the petition became void. <br /> Since the purpose is to bring the parcels into compliance,it appears the same condition should still <br /> apply: "That there shall be no further residential development on the rezoned area" <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> None <br /> DANE COUNTY HIGHWAY <br /> None <br /> OTHER <br />
