BACKGROUND <br /> A. Request <br /> The Royers seek to rezone approximately 2 acres of land from the A-1(exclusive) zoning district <br /> to the A-2(2) district. If the zoning is approved, the landowners intend to apply for a conditional <br /> use permit to allow them to manufacture furniture on the site as a limited family business. <br /> B. Site/Locational Information <br /> The property is located in Section 36 of the Town of Rutland, approximately 1,500 feet southeast <br /> of the intersection of Old Stage and Rutland-Dunkirk Roads. The property is in a rural area, <br /> approximately 5 miles south of the City of Stoughton. Badfish Creek runs from north to south <br /> along the western edge of the proposed A-2 site. <br /> C. Other federal, state or county approvals required <br /> Depending on the size of the project, Erosion Control Permits under Chapter 14 of the Dane <br /> County Code, and/or Special Exception Permits under Chapter 11 may be required. A <br /> conditional use permit, including a detailed site plan, will be required before the limited family <br /> business may begin operation. Zoning permits will be necessary before building construction <br /> may begin. <br /> II. ANALYSIS <br /> A. Compliance with County Ordinances <br /> A site plan was not provided with the application, so it is not possible to determine whether the <br /> ordinance requirements for a conditional use permit are met. The proposed A-2 zoning district <br /> would allow a number of other uses, including single family residences, that may not be <br /> appropriate for this particular site. <br /> B. Compliance with Adopted Plans <br /> The Town Land Use Plan does not specifically address limited family businesses, but does offer <br /> some comments on commercial use. See RPC staff comments for the applicability of these <br /> standards to this particular proposal. <br /> D. Environmental features <br /> Badfish Creek, along with an associated flooplain/wetland complex runs along the western edge <br /> of the proposed A-2 site. Construction site erosion controls should be in place prior to any <br /> earthmoving activities to prevent sedimentation of these water resources. Materials commonly <br /> used in furniture manufacture, such as varnishes,paints, glues or solvents, could pose a risk of <br /> ground or surface water pollution if improperly stored or contained.
