• <br /> II. ANALYSIS <br /> A. Compliance with Adopted Plans <br /> According to the Town of Verona Land Use Plan (adopted 1987), the property is within a <br /> designated agricultural preservation area. Within such areas, nonfarm residential development <br /> on lands not classified as prime agricultural soils is permitted,provided densities do not exceed <br /> one unit per thirty five contiguous acres owned at the time A-1 (exclusive) zoning was adopted. <br /> The Town of Verona adopted A-1(ex) zoning in 1979. <br /> As noted above, in 1979 the Merlises' property was part of a 137 acre farm owned by Lerner <br /> Enterprises, Inc. Under the town plan,this would yield a total of three splits (Verona does not <br /> have a rounding policy). Since that time, the density study shows that a total of eight new legal <br /> or zoning lots have been created. Of those eight lots, two (Petition 7183) are zoned or deed <br /> restricted to prohibit residential development, and one (part of CSM 7339 Lot 2) is_a zoning lot <br /> attached to an existing lot,not a separate building site. This leaves a total of 5 existing building <br /> sites (including the Merlises present home) that would count against the town's density <br /> limitations (see Map 2), two more than what the town plan would normally allow. <br /> In an attempt to compensate for this, the ZNR in 1996 applied deed restrictions to adjoining land <br /> in the Town of Middleton when one of the lots on adjoining portions of the original farm was <br /> created (Petition 6658, Frank Burgess). Since the Merlises do not own adjoining land in other <br /> townships, this would not appear to be an option for the current petition. <br /> Petition 7413 would exacerbate this situation, creating two new building sites for a total of seven, <br /> three more than the town plan aniticipates. <br /> B. Public, Local Government, And Agency Input <br /> As of the date of this report,the position of the Town of Verona was not known. No other <br /> county or state agencies have commented on this proposal. <br /> III. CONCLUSIONS <br /> A. Summary of main issues/findings <br /> There are currently five building sites on what was originally a 137 acre farm in an area <br /> designated for agricultural preservation in the Town of Verona Land Use Plan. The town's <br /> density policy would allow a total of only three such sites. This petition would exacerbate this <br /> situation by creating two new building sites, bringing the total number of residential <br /> development sites to seven, four over the planned density for the area. <br /> If the Town wishes to reconsider whether this area should be part of its agricultural preservanon <br /> area,then it should make the necessary amendments to its town plan. <br />
