' J <br /> rip <br /> DANE COUNTY PLANNING AND DEVELOPMENT DEPARTMENT <br /> STAFF REPORT <br /> Petition 7413: Anthony and Ellen Merlis Public Hearing Date: 11/24/98 <br /> Town of Verona Date of this report: 11/20/98 <br /> I. BACKGROUND <br /> A. Request <br /> Anthony and Ellen Merlis seek to rezone a total of 11.34 acres from the RH-3 zoning district to <br /> the RH-2 and RH-1 districts for three building lots. The proposed 6 acre RH-2 lot would contain <br /> the Merlises' existing home, with one 2.5 acre and one 2.8 acre RH-1 lots intended for new <br /> single family residences (see Map 1). <br /> B. History/Past Actions <br /> In 1979, when the town of Verona adopted A-1(ex) zoning, the Merlis property was part of a 137 <br /> acre farm parcel owned by Lerner Enterprises, Inc. Petition# 4484, approved by the County <br /> Board on October 3, 1989, rezoned the eastern 34 acres (on the east side of Timber Lane) to RH- <br /> 3. The associated Certified Survey Map (CSM# 5964) created two lots, one of which (the <br /> subject property) was sold to the Merlises. The other lot was sold to an unrelated party. It is not <br /> known if any agreement was reached regarding which landowner(s)retained rights for further <br /> subdivision under the town's density policy. <br /> Since then,-the Merlises have not divided the 11.34 acre parcel. Property from the original farm <br /> currently owned by other landowners,however, has been the subject of several petitions and/or <br /> land divisions. Petitions 6658 (approved by the County Board on October 17, 1996) and 7183 <br /> (approved by the County Board on August 11, 1998 and currently pending CSM approval) <br /> rezoned and reconfigured portions of the property to the east to the RH-2, RH-3 and <br /> Conservancy districts for single family residences and a private prairie preserve. <br /> C. Site/Locational Information <br /> The property is in the Town of Verona, in the northeast quarter of Section 6, immediately south <br /> of the Town of Middleton line. The property is approximately three miles west of the City of <br /> Madison and approximately four miles northwest of the City of Verona. The Merlises' home is <br /> on the eastern portion of what would be Lot 2 on the preliminary CSM. <br /> Single family residences border the site to the northeast, east and southwest, with agricultural <br /> uses,primarily grazing and pasture land, to the north, south and west. The Town of Verona Land <br /> Use Plan identifies the site's location as within an agricultural preservation area. <br /> D. Other federal, state or county approvals required <br /> A Certified Survey Map will be required, and a delayed effective date has been requested. <br /> County zoning and sanitary permits will be necessary before buildings can be constructed or <br /> occupied. Town building or driveway access permits may also be required. <br />
