Sheehan Park(the site of Sun Prairie's annual Corn Festival), a Little League baseball complex <br /> and three or four single family residences border the property to the north, all within 700 feet of <br /> the proposed recycling center site. The City of Sun Prairie has zoned the area to the east for <br /> heavy industrial use, and there are two or three commercial/industrial plants and one farmstead in <br /> this area. Railroad tracks run across the southeastern edge of the property,with a mix of <br /> cropland,pasture and wetlands to the west. (See attached map.) <br /> The municipal boundaries of the City of Sun Prairie surround the property on three sides, and the <br /> site is within the City of Sun Prairie Urban Service Area. It seems likely that this area will <br /> ultimately be annexed to the City of Sun Prairie,but the presence of two small residential lots <br /> within the Town of Sun Prairie on the extreme northern tip of the area may prevent annexation <br /> from taking place at this time. <br /> D. Other federal, state or county approvals required <br /> 1995 aerial photography shows a stream with two branches running along the southeastern and <br /> western edges of the property,ultimately draining into the Koshkonong Creek. Zoning permits <br /> will be necessary before any temporary or permanent structures could be placed on the property. <br /> Unless field investigations show these streams to be non-navigable, a special exception permit <br /> from the county Board of Adjustments may be necessary before filling or grading could take <br /> place. An erosion control plan approved by the Land Conservation Department and appropriate <br /> permits under Chapter 14 of the Dane County Code may also be required. <br /> II. ANALYSIS <br /> A. Compliance with County Ordinances <br /> The City of Sun Prairie does not have extraterritorial zoning authority in the Town of Sun <br /> Prairie, so the county zoning ordinance (Chapter 10, Dane County Code) applies. Section <br /> 10.123(3)(c) of the County Code allows"governmental uses" as a conditional use in the A-1(ex) <br /> Exclusive Agriculture District. Section 10.255(2)(h) of the County Zoning Ordinance requires <br /> any conditional use to meet all of the following standards: <br /> 1. That the establishment, maintenance, or operation of the conditional use will not be <br /> detrimental to or endanger the public health, comfort or general welfare. <br /> 2. That the uses, values, and enjoyment of other property in the neighborhood for purposes <br /> already permitted shall be in no foreseeable manner substantially impaired or diminished by <br /> establishment, maintenance or operation of the conditional use. <br /> 3. That the establishment of the conditional use will not impede the normal and orderly <br /> development and improvement of the surrounding property for uses permitted in the district. <br /> 4. That adequate utilities, access roads, drainage and other necessary site improvements have <br /> been or are being made. <br /> S. That adequate measures have been or will be taken to provide ingress and egress so designed <br /> as to minimize traffic congestion in the public streets; and <br /> 6. That the conditional use shall conform to all applicable regulations of the district in which it <br /> is located <br /> 2 <br />
