Please note that the <br /> conditions are based in part on policies included in the Town's recently amended plan, <br /> which comes before the ZNR at the May 27 public hearing. The Town submitted the <br /> following conditions of approval in its action report: <br /> "Deed restrict no more development on land/parcels owned in town of <br /> Christiana (parcels [0612]-073-8071, [0612]-073-8500, [0612]-073-8690, <br /> [0612]-073-9571, [0612]-073-9011,for 5 years and limited to only one (1) more <br /> development right on land/parcels owned in township as per amended January <br /> 2003 land use plan for Town of Christiana. " <br /> The relevant Town plan policy from the amended plan requires the timed phasing of <br /> permitted splits over consecutive 5 year periods. Please refer to the policy, below. <br /> From Density Policy 1D): <br /> PHASING OF SPLITS REQUIRED <br /> As of January 14, 2003, original May 3, 1979 farm parcels that are eligible for <br /> more than one lot will be restricted to one lot every five years, as long as all other <br /> criteria are met... <br /> From Administration and Tracking of Phasing Policy: <br /> The Town will administer the phasing policy through the use of deed restrictions <br /> and/or notice documents. Approval of the first one-lot rezone permitted under <br /> this policy shall be conditioned upon the filing of a deed restriction preventing <br /> additional development for 5 years on that portion of the May 3, 1979 farm unit <br /> owned by a petitioner. <br /> The applicant is agreeable to the Town's conditions and is also aware of the fact that the <br /> amendments have not yet been adopted by Dane County under the Dane County <br /> Farmland Preservation Plan. <br />
