C. Town Density Policy <br /> At their March 3, 2003 meeting, the Town of Cottage Grove Board of Supervisors clarified their <br /> previous approval of Petition 8632 (minutes attached). The Town Board has indicated that Mr. <br /> Viney will be transferring 2 Residential Dwelling Units (RDUs) from property he owns <br /> elsewhere in the town, as allowed in the town's recently adopted comprehensive plan. <br /> (Scheduled for a 3/25/03 public hearing for adoption as part of the Dane County Farmland <br /> Preservation Plan.) <br /> RDUs will be transferred from the following parcels: <br /> "One split will come from the former Pendorf farm on Nora Rd. (Parcel #0711-264-9000-7) and <br /> the other split will come from the former Delaine Helickson farm on Highway 12 & 18 (Parcels <br /> #0711-274-9010-3 and 0711-341-8080-9). Both are now owned by Donald Viney. " <br /> Density study reports for both sending area properties are attached. If this petition is approved, it <br /> would leave the Nora Road property with one remaining RDU, and will exhaust the RDUs on the <br /> Highway 12 & 18 property. Deed restrictions and deed notices will be needed to track <br /> transferred RDUs. <br /> D. Recommended conditions <br /> The committee may wish to impose a 12-month delayed effective date,by which time the <br /> landowner must complete the following: <br /> a. Record with the Dane County Register of Deeds a subdivision plat that fully complies with <br /> Chapter 75 of the Dane County Code and with stormwater and erosion control provisions of <br /> Chapter 14 of the Dane County Code; <br /> b. Record with the Dane County Register of Deeds deed restrictions, in a form acceptable to the <br /> zoning administrator,prohibiting further development on the following parcels: <br /> • CSM 9983, Lot 1. <br /> Such deed restriction shall also indicate that any "splits"or "Residential Dwelling Units" <br /> allocated to that property by previous agreements and/or the Town of Cottage Grove <br /> Comprehensive Plan have been transferred to lands described in Dane County Rezone Petition <br /> 8632. <br /> c. Record with the Dane County Register of Deeds deed notice documents on the 1982 Lois Roe <br /> landholdings indicating that further development would require participation in the town's <br /> Transfer of Development Rights (TDR)program (proposed deed notice documents, with legal <br /> descriptions, attached). a. Record with the Dane County Register of Deeds a subdivision plat that fully complies <br /> with Chapter 75 of the Dane County Code and with stormwater and erosion control provisions of Chapter 14 of the <br /> Dane County Code; <br /> b.
