BACKGROUND <br /> • <br /> A. Request <br /> Ronald Trachtenberg, acting as agent for the Mishpacha LLC, seeks to rezone one 2-acre parcel <br /> and one 1.99 acre parcel in the Town of Verona from the A-i Exclusive Agricultural district to <br /> the RH-1 Residential district. The landowner intends to put a single family residence on each <br /> parcel. Note that the two RH-1 parcels created are for zoning purposes only, and are not <br /> surveyed lots. The proposed RH-1 zoning lots are surrounded by larger(>35 acres) lots <br /> proposed as part of a four-lot certified survey map. These larger areas will remain in A-1 <br /> (exclusive)zoning. The four surveyed lots, along with the zoning lots within them, will be <br /> served by a private road that connects with Sugar River Road. <br /> B. Site/Locational Information <br /> The property is in Sections 19, 20 and 30 in the Town of Verona, a quarter of a mile south of the <br /> intersection of Sugar River Road and County Trunk Highway G. The property is in a rural area, <br /> approximately 1.5 miles west of the City of Verona. There is apparently a building and a <br /> driveway on the site, although the Zoning Division reports that no permits have been issued. <br /> Portions of the site are currently planted in corn. The surrounding area is a mix of active <br /> cropland,pasture and woodland. There are some scattered farm residences to the south and east. <br /> II. ANALYSIS <br /> A. Compliance with County Ordinances <br /> Since the lots in the proposed certified survey map for this property exceed 35 acres and would <br /> remain in common ownership with the proposed zoning parcels, county subdivision ordinance <br /> requirements for frontage on a public road do not apply. If however, either of the two proposed <br /> RH-1 lots are ever sold to another landowner,new certified survey maps would have to be <br /> recorded. At that time, all provisions of the county subdivision ordinance, including access to a <br /> public road, would have to be met. <br /> B. Compliance with Adopted Plans <br /> Town Land Use Plan <br /> According to the Town of Verona Land Use Plan (adopted 1987), the site is within an <br /> agricultural preservation area. Within such areas,the plan allows"nonfarm residential <br /> development by certified survey map in those areas with soils not classified as prime farmland at <br /> a density of one lot per 35 contiguous acres owned,with a minimum lot size of two acres..." <br /> As submitted,the southern RH-1 lot(1.99 acres)would appear to fall just short of this minimum. <br /> 1 <br />
