Timothy Lovett, agent-attorney),Roxbury 3 <br /> Amend Deed Restrictions recorded for previous Rezone Petitions 6083/CUP 1190& <br /> 6461/CUP 1295 <br /> This petition seeks to delete one item from a deed restriction which applies to property which <br /> subsequently was platted as Summer Place on the Lake Condominium Plat, and which is being <br /> developed as a recreational use mobile home park. The language to be deleted is: <br /> "The mobile homes placed on the above described real estate shall only be occupied from <br /> April 1 to November 1 of each year, and any mobile home park located upon said real <br /> estate shall only be operated from April 1 to November 1 of each year." <br /> Previous rezones include: <br /> • Rezone 6083 (effective 01/02/1995 /CUP 1190 (effective 02/28/1995) created the westerly <br /> "1/2" of an R-4 zoned area to be used a mobile home park(and an RE-1 area for recreational <br /> use, which is not affected by this petition.) <br /> • Rezone 6461 (effective 04/26/1995 /CUP 1295 (effective 05/14/1996) created the easterly <br /> "1/2" of the R-4 area for the mobile home park. <br /> • Rezone 7110 was filed for the 12/16/1997 ZNR Comm. P.H.,but was withdrawn. It was <br /> identical to the current petition. An extensive review of the implications of year-round <br /> residency was completed by the Planning Dept. before the withdrawal. <br /> Please Note: In addition to amending the deed restrictions which limit year-round use of the <br /> mobile home park and which are part of Rezone Petitions 6083 and 6461, a owners must also <br /> amend the Conditions of CUP 12911 which includes the same language. <br /> Note: Much of this property is in a Shoreland district. The Ordinary High Water Mark of Fish <br /> Lake was increased from 856.46 MSL(as of 11/03/1998)to 858.70 MSL(as of 06/17/1998.) <br /> Reports on the"History of Rezone 6083 /CUP 1190 as it pertains to Rezone 7110" and on the <br /> "History of Rezone 6461 /CUP 1295 as it pertains to Rezone 7110," as well as correspondence <br /> relating to Senior Planner Brian Standing's review of Rezone 7110 are available in the file. <br /> REGIONAL PLANNING <br /> Petition 7287. This recreational mobile home park site was rezoned several years ago with many <br /> conditions in an attempt to correct previous development problems and help protect Fish Lake. <br /> Because the new development and use of mobile homes was going to be dependent on holding <br /> tanks,there were seasonal use restrictions placed on the site. <br /> The request is for the removal of this seasonal use restriction,which would allow year-around <br /> occupancy. <br /> A similar request was made in December 1997 (Petition 7110)but was subsequently withdrawn. <br /> There does not appear to be any mitigating reasons to change the restriction and allow for <br /> permanent residential use. <br /> ENVIRONMENTAL HEALTH (septic, etc.), <br /> The proposed amendment does not have any negative public health implications.No objection to <br /> this petition. <br /> DANE COUNTY HIGHWAY <br /> OTHER <br />
