Add two new conditions: <br /> 8. The condominium units numbered 1 through 36 on the Summer Place on the Lake <br /> Condominium Plat shall be deed restricted to permanently remain in open space or <br /> natural area use. Any legally permitted structures on these units, as of the date of this <br /> action, shall be treated as nonconforming structures in accordance with Section 10.23 of <br /> the Dane County Zoning Ordinance. <br /> 9. Remaining land owned by Fish Lake Development Corporation, including the entire <br /> northwest quarter of the southwest quarter of Section 2, Town of Roxbury and Parcels <br /> Numbered 18001, 18530 and 19501 in Section 3, Town of Roxbury shall be deed <br /> restricted to non-structural use. <br /> Note that the reduction from 100 mobile homes to 64 mobile homes allowed corresponds to the <br /> deed restrictions proposed for the 36 units along the shore. These deed restrictions were <br /> predicated on the uncertainty of the water levels of Fish Lake. Sometime after 2/13, I recall a <br /> conversation with either Kristine of Topf where I was instructed to let the subcommittee know <br /> that Condition 9 might be open to negotiation. However, before this piece of information could <br /> be relayed to either the subcommittee or Mr. Kearney, Mr. Kearney withdrew Petition 7110 <br /> from consideration. <br /> • C. Staff recommended the following changes to the proposed conditions for Petition 7287, <br /> after the DNR had established a new ordinary highwater mark for Fish Lake, and after the zoning <br /> administrator had made an initial determination of the effect this change would have on <br /> condominium units 1 through 36 (the numbering may vary, but the language is the same -- see <br /> Supplementary Staff Report dated 9/2/98): <br /> Condition 4, above, regarding number of mobile homes allowed is omitted—plat allows only 104 <br /> units; <br /> Condition 8 above omitted due to determination of OHWM of Fish Lake; <br /> Condition 9 above omitted due to understanding from the County Executive Office; <br /> • <br /> Two new conditions added: <br /> 1. Prior to the issuance of any zoning permits for construction or location of any structure on <br /> any condominium units with frontage onto Fish Lake, a development plan signed by a <br /> licensed surveyor shall be submitted to the Zoning Administrator. Such plan shall show the <br /> location of the current ordinary highwater mark of Fish Lake as established by the <br /> Department of Natural Resources, and shall show all applicable zoning setback lines. <br /> 2. Condominium units 1 through 36 shall be deed restricted with a document acceptable to the <br /> Zoning Administrator and recorded in the Register of Deeds, that notifies condominium or <br />
