land owners that the water levels of Fish Lake may continue to rise, and that their structures
could become nonconforming and/or experience flooding in the future.
CURRENT STATUS:
On September 8, 1997, the ZNR voted 4-1 to recommend approval of Petition 7287 with the
following conditions:
1. The above described real estate shall be used only for a recreational mobile home park for so
long as said real estate shall be zoned R-4.
2. The maximum number of mobile homes allowed to be placed on the above described real estate
shall be limited to 100 for so long as said real estate shall be zoned R-4.
3. Condominium units 1 through 36 shall be deed restricted with a document acceptable to the
Zoning Administrator and recorded in the Register of Deeds, that notifies condominium or land
owners that the water levels of Fish Lake may continue to rise, and that their structures could
become nonconforming and/or experience flooding in the future;
Require the submittal of a development plan, dated August 27, 1998, showing the location of the
current ordinary highwater mark of Fish Lake as established by the DNR, and all applicable
zoning setback lines.
In addition to the documents referenced above, I also have attached a memo I drafted at the
direction of the subcommittee discussing the applicability of a TDR concept to Petition 7110.
This may have some relevance to the discussion about deed restrictions on other properties
owned by Fish Lake Development Corporation.
I hope this meets your needs. Please feel free to call me at 267-4115 if I can be of any further
assistance.
