„, XLEY BRYNELSON,LLP
Attorneys Stoce 1885
In addition, the Hidden Valley Road Association has had 18 years of success in maintaining
this road. The road has been more than adequate for fire, ambulance, police, construction, utility and
service vehicles. Aside from one incident involving a school bus on an extremely icy day, I know
of no other problems encountered on the road. We've maintained the road as requested by the
schools, the fire and EMS departments, the trash haulers, etc. In fact the local fire department uses
our road for rural fire training.
Finally, despite suggestions to the contrary, the local fire department or EMS would respond
to Hidden Valley Road approximately 6 minutes sooner than it could respond to a similar emergency
across the valley on Observatory Road.
In sum, zoning my property for agricultural uses has no reasonable, rational basis. It is not,
and never was productive agricultural land. A rezone to RH for this 10 acres allows a reasonable
use and makes it compatible with other similar parcels.
(3)The Granting of This Rezone Is Compatible with Neighboring Properties, and Will Not
Be Detrimental to Public Welfare or Injurious to Other Properties.
First, this is not injurious to other properties:
- the County's Notice of Hearing, Exhibit F, shows this as
contiguous to an RH-1, and within 2 "iron shots”of RH-2,
RH-3, and RH-4 properties along Observatory Road.
Exhibit F is probably the most telling exhibit— it shows 9 neighboring parcels with RH
zoning.
-9-
