LIALEY BRYNELSON,LLP
Attorneys Since 1885
On a personal note, most of my neighbors and I bought our property 18 years ago. We did
so with the common, shared belief that we could strike a responsible balance between preserving
nature and building private homes. Our 18 years have been quite successful in that regard, and my
neighbors know that I have done everything within my power to protect the environment and
ecology of this area. They—and I—know this parcel better than any ZNR member or staff, and
they would not stand by quietly if the RH-3 was not a reasonable, responsible use of the property.
While some of the Dane County Board are concerned with developing a larger, sensible land
use plan for the county,—until that plan is developed—the board should also trust the common
judgment of the neighbors and the Town, and grant a rezone to RH where the situation is unique,
wholly unusable for agriculture, and not detrimental to public welfare. We live in the country for
different reasons, but this summarizes many of our thoughts:
Everybody needs beauty as well as bread, places to plan in and pray
in,where nature may heal and clear and give strength to the body and
soul alike.
John Muir
Travels in Alaska
(4) The Rezone Will Not Hinder Public Safety
Granting this rezone will also have the practical affect of granting a variance to the 66'
"abutting or affronting"requirements of D.C.O. 75.19(6)(b). To that end, I address the private road
issue.
The Private Road Fallacy: Some might argue this rezone should not occur because Hidden
Valley Road is a private road— and necessary services could be compromised.
