1 <br /> RESOLUTION T.B.E. 7-1-97-2 <br /> ADOPTING CLARIFICATION TO LAND USE PLAN <br /> WHEREAS, the Town of Black Earth has the function and <br /> duty of making and adopting a Land Use Plan; and <br /> WHEREAS, the Town of Black Earth prepared and adopted <br /> a Land Use Plan in June 1981 and updated it in March <br /> 1996; and <br /> WHEREAS, the Town of Black Earth Land Use Plan -states, <br /> a substandard parcel is, for the purposes of this plan, <br /> a parcel of less than 35 acres in size which existed <br /> prior to June 3, 1981 (page 14 ) ; and <br /> WHEREAS, in the Town of Black Earth zoning petition <br /> 86829, where Mr . Bareness acquired one parcel in <br /> 09/29/69 (6 acres) and the other parcel in 06/14/77 <br /> ( 12 acres); and <br /> NOW, THEREFORE, BE IT RESOLVED that our Land Use committee <br /> and our Town Board approved the split of the 6 acre parcel <br /> to create one additional residential site and the split of <br /> the 12 acre parcel to create two residential sites; and <br /> BE IT FURTHERED RESOLVED, that the Town of Black Earth has <br /> previously created splits (reference petition M6278 6 05751 ) <br /> and this would not create any additional precedent; and <br /> BE IT FURTHERED RESOLVED, that this will exhaust all <br /> allowable splits under current policies; and <br /> BE IT FINALLY RESOLVED, that under a comprehensive rezone <br /> by the Town and County, we would grant these splits . <br />
