undeveloped wooded uplands, pasture, and farmlands. There is one four-acre rural residential parcel <br /> owned by the Strangs adjacent to and immediately west of Parcel B. All of the adjacent parcels are zoned <br /> A-1 Agriculture(Exclusive). <br /> D. Other federal,State or County Approvals Required <br /> Per Chapter 75 of the Dane County Code of Ordinances, Land Division and Subdivision Regulations, a <br /> certified survey map is required because one of the parcels to be created(Parcel B)as a result of this land <br /> division is less than 35 acres. <br /> As noted earlier in regard to Petition 7069, approval was contingent upon a deed restriction that <br /> prohibited further development on the balance of the applicant's land. The same arrangement has been <br /> proposed by the applicant in the current petition. <br /> Due to the slopes on the subject property,particularly the slopes on Parcel B,the applicant should consult <br /> with the Dane County Land Conservation Department to determine if an erosion control plan is required. <br /> As part of the previous petition process, the applicant met with the Land Conservation Department, and <br /> an erosion control plan was submitted to the County. <br /> Depending on where the applicant chooses to pursue access, they may or may not need to get a highway <br /> access permit from WisDOT. In Petition.7069, an access agreement was reached with the Strangs, who <br /> own the property west of and adjacent to Parcel B. Attachment A indicates the approximate alignment of <br /> the previous access agreement. Under this arrangement, WisDOT indicated that a highway access permit <br /> was not required. It is not clear if the same access arrangement will be pursued in the present petition. <br /> Slope will be a significant issue if the previous arrangement is not pursued. The Town of Black Earth <br /> Land Use Plan indicates that". . .development shall not require a driveway of more than 10 percent slope <br /> in order to assure access by fire and emergency vehicles. Driveways must meet the requirements of the <br /> Town's Driveway Ordinance." <br /> Since Parcel B is presently smaller than 35 acres, Chapter 75 of the Dane County Code of Ordinances <br /> requires that this parcel have 66' of public road frontage,which it does,not have. However, it seems to be <br /> the intent of the applicant to join Parcel B to the Turk parcel to the south. Following this consolidation, <br /> the resulting parcel would be greater than 35 acres and would not need public road access; the above- <br /> noted access arrangement could then be.allowed. The larger parcel resulting from the consolidation <br /> would have frontage along Kahl Road, but the topography along this right-of-way is sufficiently steep so <br /> as to prohibit driveway access. <br /> Both sanitary permits and zoning permits will be required for the two new residences. In Petition 7069, a <br /> preliminary opinion of site suitability for a private sewage disposal system was issued by the Dane <br /> County Division of Public Health stating that the areas inspected met the minimum requirements of the <br /> Wisconsin Administrative Code for the installation of either a mound system or an at-grade mound <br /> system. <br /> II. ANALYSIS <br /> A. Compliance with County Ordinances <br /> The County Zoning, Subdivision,and possibly Erosion Control ordinances apply. Any buildings used for <br /> human occupation must be appropriately permitted and have an installed septic system. <br /> Page2of4 <br />
