B. Compliance with Adopted Plans <br /> The subject property is within the Agricultural Preservation Area of the Town of Black Earth Land Use <br /> Plan. However,the subject area parcels are primarily steep wooded slopes and unfarmed pasture deemed <br /> by the applicant to be unsuitable for fanning. <br /> As noted above, the Town requires that the ". . . development shall not require a driveway of more than <br /> 10 percent slope in order to assure access by fire and emergency vehicles. Driveways must meet the <br /> requirements of the Town's Driveway Ordinance." This issue was addressed earlier and is contingent <br /> upon the access agreement with Strang and the consolidation of Parcel B with the Turk parcel. <br /> Furthermore, the Town Plan has a policy that states, "The proposed development shall not disturb or <br /> destroy any important natural features such as significant woodland areas, wetlands, steep slopes, etc." <br /> Much of the subject area is comprised of steep,wooded slopes. In order to comply with the Town Plan, <br /> the applicant should be mindful of this policy when siting the actual location of the two residences. <br /> C. Environmental Features <br /> As noted, the subject area is mostly wooded uplands and does not include any floodplains or wetlands. <br /> There appears to be no hydric soil immediately within the subject area. There is a large portion of the <br /> area where the slope exceeds 12 percent, and most of this area,is heavily wooded. Steep wooded slopes <br /> are critical in the aquifer recharge process, help reduce runoff, and should be preserved whenever <br /> possible. <br /> The subject area is within a Wellhead Protection Area as identified in the Dane County Water Quality <br /> Plan, but the scale of the project is so minor as to not present any significant wellhead protection <br /> concerns. <br /> There is a drainage way on the south side of the Turk parcel that drains down to Kahl Road and <br /> ultimately into a wetland south of Kahl Road and north of USH 14;this same drainage way may also flow <br /> into the Black Earth Creek trout stream immediately south of USH 14. This significant drainage pattern <br /> is another reason for the applicant to consult with the Land Conservation Department in regard to erosion <br /> control issues. <br /> D. Public,Local Government,And Agency Input <br /> As noted previously,no Town action has yet been taken,nor has Planning and Development received any <br /> comments regarding this petition from other County departments. <br /> Page 3 of 4 <br />
