DANE COUNTY PLANNING AND DEVELOPMENT DEPARTMENT <br /> STAFF REPORT <br /> Petition # 7350:Sharon & Ervin Lee Public Hearing Date: 9/15/98 <br /> Town of Cross Plains Date of this Report: 10/8/98 <br /> I. BACKGROUND <br /> A. Request <br /> Sharon and Ervin Lee are asking to rezone 6.8 acres of land in the Town of Cross Plains from the <br /> A-1 (exclusive) zoning district to the RH-2 Rural Homes District for a single family residence. <br /> B. History/Past Actions <br /> There are four apparent lots and a 66-foot wide easement on the property that, according to the <br /> Plat Review Officer, were created illegally some time ago, without Certified Survey Maps or <br /> subdivision plat documents. This was apparently done in conflict with county subdivision <br /> ordinance requirements in effect at the time the land was divided. <br /> C. Site/Locational Information <br /> The property is located in the western half of the northwest quarter of Section 7, Town of Cross <br /> Plains, immediately east of the Vermont/Cross Plains town line. The Lees currently own <br /> approximately 400 acres on both sides of the town line. The Lees' current Cross Plains holdings <br /> include lands that in 1981 (the date the Town first adopted their land use plan)were three distinct <br /> farms under different ownership (See Map 1, attached). The proposed lot configuration would <br /> include lands from two of these farms, 4.8 acres from the old O'Brien farm (84 acres in 1981), <br /> and 2 acres from the old Raymond Lee farm (198 acres in 1981) (See Map 2). The 2-acre flag <br /> portion of the proposed RH-2 lot would provide the property with 66 feet of frontage on the <br /> north side of Union Valley Road. <br /> The property is bordered on the east by the noncompliant residential lots to the east. The <br /> remainder of the area is a mix of cropland,pasture and woodland. The site is in a rural area, <br /> approximately 2.5 miles west of the Village of Cross Plains. <br /> D. Other federal, state or county approvals required <br /> A certified survey map will be required and a delayed effective date is recommended. County <br /> zoning and sanitary permits and certificates of compliance will be necessary before buildings can <br /> be constructed or occupied. Driveway permits from the Town of Cross Plains may also be <br /> necessary. <br /> II. ANALYSIS <br /> A. Compliance with County Ordinances <br /> The proposed RH-3 zoning is appropriate for the intended use, and lot sizes meet the <br /> requirements of the County Zoning Ordinance. Prior land divisions on this property, including <br /> land not currently owned by the Lees, were created without certified survey maps or plats, and <br /> would appear to have inadequate road access as required by the County Subdivision Ordinance <br /> 1 <br />
