The Plat Review Officer has determined that the resulting <br /> parcels are illegal, since they did not comply with the subdivision ordinance at the time they <br /> were created. By creating a CSM for the new lot, this petition would at least bring one of these <br /> illegally created lots into compliance with county standards. Staff caution, however, that the <br /> county should avoid giving the impression that it is legitimizing any remaining illegally created <br /> lots through any action on this current petition. See comments below concerning the distinction <br /> between compliance with the subdivision ordinance and consistency with the town plan. <br /> B. Compliance with Adopted Plans <br /> • Town Land Use Plan <br /> The Town of Cross Plains Land Use Plan, adopted in May of 1981, shows the site within an <br /> agricultural planning district, where the following policy applies: <br /> "Lands in the agricultural district should not be rezoned for non farm residential development at <br /> an overall density of greater than one dwelling per 35 acres owned as of the dale of adoption of <br /> this plan. " <br /> The town plan is silent about how to treat parcels that incorporate land from more than one 1981 <br /> landholding. As noted above, the proposed RH-3 lot includes land from two original farms. On <br /> the old O'Brien farm of 84.19 acres,two (illegal) splits have taken place. This would appear to <br /> exhaust the available land divisions under the land use plan for this particular parcel. Note that <br /> this determination applies only to interpreting the land use plan, and is not intended to condone <br /> or indicate acceptance of illegally created parcels of land. At some point, it is clear that certified <br /> survey maps or maps will be necessary to bring the entire area into compliance. <br /> On the 1981 Raymond Lee farm of 198 acres, no splits have been taken, leaving 5.6 land <br /> divisions available. Although the proposed two acre flag taken from the Raymond Lee farm is a <br /> minority of the total proposed area for the new lot, there would appear to be nothing inherently <br /> inconsistent with counting the split against this as yet undivided larger parcel. <br /> C. Environmental features <br /> The property sits on the eastern slope of a mostly wooded hillside. Slopes range from almost <br /> 30% along the eastern edge of the proposed parcel,to approximately 10% on the northern 2/3 <br /> acre. Buildings, driveways and other improvements should be located on the northern and <br /> western edges of the lot to avoid disturbing areas with steep slopes. Appropriate erosion controls <br /> for single family residential construction under the Uniform Development Code should also be <br /> applied. <br /> D. Public, Local Government, And Agency Input <br /> • Town Board Action <br /> On September 4, 1998,the Cross Plains Town Board voted unanimously to approve Petition <br /> #7350 with no conditions. <br /> At the time of this report, no other local unit of government or county agency had commented on <br /> this proposal. <br /> 2 <br />
