Each of these issues are addressed <br /> below. <br /> 1. The Proposed Rezoning Complies With The Relevant Town/County <br /> Policies. <br /> The Town of Christiana Plan Commission unanimously (one abstention) <br /> approved the proposed rezoning. The Town of Christiana Plan Commission is the <br /> body primarily responsible for planning in the Town. The Town of Christiana <br /> Town Board also unanimously approved the proposed rezoning. The Town Board <br /> is the governing and legislative body of the Town. What better evidence could <br /> there possibly be that the proposed rezoning complies with the relevant town <br /> policies than the unanimous approval of the Town Plan Commission and Town <br /> Board. After all, the interpretation of the legislative body that promulgated the <br /> policies must be given greater weight than any other interpretation. <br /> In approving the proposed rezoning, the Town Plan Commission and Town <br /> Board had to determine that the proposed rezoning would not result in a <br /> commercial strip development along a highway. Town of Christiana Land Use <br /> Plan ("Town Land Use Plan"), at 4 (the policy reads To prohibit strip <br /> development") (a copy of such page is enclosed herewith). The Town Land Use <br /> Plan defines "Strip Development" as follows: <br /> Strip Development: the development of a series of commercial or <br /> residential land uses generally one lot deep along a road or highway, <br /> with each use usually requiring an access to the road. <br /> Town Land Use Plan, at 6 (a copy of such page is enclosed herewith). <br /> The proposed rezoning will not result in strip development as defined for <br /> several reasons. First, an examination of the Zoning Maps for Sec. 1 and Sec. 2 in <br /> the Town of Christiana reveals numerous commercially zoned parcels along the <br /> North and South sides of U.S.H. 12 & 18 and extending East and West of the <br /> parcel proposed to be rezoned. (See reduced copies of Zoning Maps for Sec. 1 and <br /> Sec. 2 in the Town of Christiana enclosed herewith; the existing commercially <br /> zoned parcels have been highlighted in yellow.) If the proposed rezoning were <br /> considered to result in "Strip Development," then logically each one of the existing <br /> commercially zoned parcels after the first in time commercially zoned parcel had <br /> to constitute "Strip Development."
