right-of-way is no longer providing safe potable water and for any reason the well ceases to function <br /> properly and needs to be replaced by Owner at the Owners'expense,the well will be removed from the <br /> highway right-of-way of Vilas Hope Road and a new well will be placed by the Owner in accordance with <br /> Town,County, and State regulations or ordinances; <br /> WHEREAS, the Owner shall maintain an insurance policy which covers repair and/or <br /> replacement of the well and shall name the Town of Cottage Grove and Dane County as additional <br /> insureds; <br /> WHEREAS, as part of the Agreement, the Owner hereby agrees to hold the Town harmless and <br /> agrees to assume all liability for the above-mentioned well and agrees to hold the Town, Dane County, <br /> the State of Wisconsin and/or their boards, commissions, agencies, officers, employees and <br /> representatives harmless from any and all liability claims or demands arising out of or by reason of any <br /> injury or damage to person or property or contamination or any other issue that may arise regarding the <br /> above mentioned well. <br /> WHEREAS, this Agreement is intended to and shall run with the land and shall bind future <br /> owners of the above-named encroachment area to its terms.
