CONTINUED WELL LOCATION AGREEMENT("AGREEMENT") <br /> BETWEEN <br /> THOMAS M.AND JULIA A.WILLAN,OWNERS <br /> 4407 Vilas Hope Road <br /> Cottage Grove,WI 53527 <br /> AND <br /> TOWN OF COTTAGE GROVE <br /> 4058 County Road N <br /> Cottage Grove,WI 53527 <br /> ENCROACHMENT DESCRIPTION: Private Well Return to: <br /> Dane County Highway Department <br /> ENCROACHMENT LOCATION:Station 8+80.52, 21.87 feet Left 2302 Fish Hatchery Road <br /> (see Exhibit"A") Madison, WI 54654 <br /> I.D. 3677❑00❑73 Madison—Cottage Grove Road(Vilas Hope <br /> Road Intersection)CTH BB Dane County Parcel Identification Number/Tax Key <br /> Number 071107299715 <br /> THIS AGREEMENT is by and between THOMAS M.AND <br /> JULIA A.WILLAN (hereinafter collectively referred to as"Owner") <br /> and the TOWN OF COTTAGE GROVE (hereinafter referred to as <br /> "Town"),and provides for the following: <br /> WHEREAS,the Town and Dane County,WI (hereinafter referred to as"County") propose to <br /> reconstruct CTH BB at its intersection with Vilas Hope Road (hereinafter referred to as the"Project"); <br /> WHEREAS,this Project is funded with federal and state funding from the Wisconsin Department <br /> of Transportation through the Highway Safety Improvement Program (HSIP); <br /> WHEREAS,this Project is scheduled to be let by the Wisconsin Department of Transportation; <br /> WHEREAS,this Project will be constructed by the contractor who is awarded this Project by the <br /> Wisconsin Department of Transportation in accordance with all federal and state laws; <br /> WHEREAS,this Project will be administered by the Wisconsin Department of Transportation; <br /> WHEREAS,this Project is scheduled to be constructed during the summer and/or fall of 2013; <br /> WHEREAS,the Owner presently has a well that is on the right-of-way of Vilas Hope Road; <br /> located at Station 8+80.52, 21.87 feet Left(see Exhibit"A"); <br /> WHEREAS,the Owner agrees to become a member of Diggers Hotline for safe operation of <br /> facilities on public right-of-way; <br /> WHEREAS,the Town will issue a permit to the Owner to operate and maintain utility facilities on <br /> the highway right-of-way for the existing well and water supply line at or near station 8+80.52; <br /> WHEREAS,the Owner agrees that in the event the potable water well at this location on the <br /> C:\USERS\CANDERSON\APPDATA\LOCAL\TEMP\OZO4 VRRF\3007053.DOCX <br /> 1217121411 <br />
