This permit has been issued with the und.rstanding that any construction equipment used is the right <br /> size to do the job, and can be brought to and removed from the project's site without unreasonable <br /> harm to vegetative cover or fish or wildl fe habitat. This permit may be rescinded or revoked if the <br /> Department determines that the condition of this permit have not been followed or if it finds the <br /> activity to be detrimental to the public i:terest. <br /> 14. You will assume all responsibility and liability for any direct or indirect damage caused or resulting <br /> from the presence of the bridge and shal hold the State of Wisconsin, and its employees, harmless. <br /> 15. The Department has not done an analysi• of the bridge's ability to support loads to be imposed upon <br /> it. <br /> 16. You are not authorized to place any f 1 on the streambed, or cause any other alteration of the <br /> waterway which might require a Depart ent of Natural Resources permit. <br /> 17. The authority herein granted can be • -nded or rescinded if the bridge and/or culvert become an <br /> obstruction to navigation or otherwise .ecomes detrimental to the public interest. <br /> FINDINGS OF FACT (Facts which were onsidered in making this decision.) <br /> 1. Bradt Farms Inc. has filed an application for a permit to grade in excess 10,000 sq.ft. on the bank <br /> of a tributary to Door Creek in the Tow of Cottage Grove, Dane County, in the NW'/a of the NE 1/a <br /> of Section 8, Township 7 North, Rang; 11 East. The project is located at 4226 Vilas Road. <br /> 2. The project will consist of construction of a nine hole golf course. The project will include grading <br /> on the bank of and placement of a culv-rt and a bridge on the bed and bank of a tributary to Door <br /> Creek. A portion of the project was co pleted last winter and included minor grading and placement <br /> of a culvert in the waterway. The gr.•ing will be done to construct raised greens and tee boxes. <br /> A 42-inch culvert pipe will be placed in the stream, replacing an existing 18-inch culvert. In addition <br /> a wooden bridge will be constructed o er the waterway. Both the bridge and culvert are proposed <br /> to create golf access on both sides of e waterway. <br /> This tributary to Door Creek is a navi;:able water of the state. <br /> 3. The Department has completed an inv stigation of the project site and has evaluated the project as <br /> described in the application and plans. <br /> . 4. The proposed project will not materi•lly obstruct navigation and will not be detrimental to other <br /> public interests if constructed in accor•ance with this permit. <br /> 5. The proposed project will not impact etlands. <br /> 6. The Department has determined that g anting or denying this permit does not constitute a major state <br /> action significantly affecting the quali y of the human environment. <br /> 7. The Department of Natural Resources and the applicant have completed all procedural requirements <br /> and the project as permitted will •omply with all applicable requirements of Sections 1.11, <br /> 30.19(1)(c), 30.123, 30.12(3) Wisco sin Statutes and Chapters NR 102, 103, 115, 116, 117, 150, <br /> 299, 320 of the Wisconsin Administr:tive Code. <br />
