Zoning Petition# 7272 <br /> DANE COUNTY DEPARTMENT OF PLANNING AND DEVELOPMENT <br /> STAFF REPORT <br /> PETITION # 7272 (Don Zeman) Public Hearing Date: 6/23/98 <br /> I. BACKGROUND <br /> II. Current Petition: <br /> Don Zeman is petitioning to rezone about 2 acres of his 145 acre farm from A-1 EX to <br /> M-1 and sell the parcel to his agent, Richard Barmen. Bannen plans to start a new"metal, <br /> structural, ornamental railing fabrication" business, and would also do "farm repair on <br /> farm equipment." He would have five to 10 employees. He plans to build a 90 by 125 <br /> foot, two-bay fabrication shop with 21 foot clearance and room for offices. This would be <br /> connected to an approximately 60 by 100 foot storage addition. <br /> B. History/Past Actions: <br /> Realignment of State Highway 113 and CTH P about five years ago separated the <br /> petitioned acres from the remainder of the farm. <br /> Zeman filed a petition (7181) on April 28, 1998 for a rezone of 3.65 acres from Al-EX to <br /> C-2 for the purposes of construction a mini-warehouse. The 3.65 acres is across CTW P <br /> from the two acres currently petitioned for rezone. The ZNR approved the petition on <br /> May 19 with the condition that the use be limited to mini-warehouse only. The County <br /> Board approved the petition on June 4. <br /> C. Site/Locational Information <br /> The property is in a rural area in the southwest quarter of the southwest quarter of Section <br /> 14, in the Town of Dane. It is a long, narrow wedge-shaped property bordered on the east <br /> and north by SH 113, the east and south by CTH P, and on the west by abandoned <br /> roadway that may still serves as a frontage road(see attached map). The site is a quarter <br /> mile west of the Village of Dane on SH 113. Two farm complexes and three smaller <br /> buildings,possibly residential, lie within 1,000 feet of the site (based on ortho photo). <br /> Another farm complex lies within 1,500 feet. <br /> The site contains Class I-II soils, but is not currently in agricultural use. 1.22 acres of this <br /> piece is a `remnant' non-conforming part of the SW SW of Section 14—that is, it was <br /> created by the road realignment, and requires rezoning and a CSM to become a legal <br /> parcel. The other 0.59 acres is "land already in use for highway purposes"—perhaps <br /> excess road right-of-way which the State and/or County routinely deeds back to adjacent <br /> property owners after completion of a project. The soils under the old roadway are likely <br /> significantly compacted. <br /> D. Other approvals required <br /> A certified survey map must be approved before any rezoning becomes effective. Zoning <br /> petition 7181, referenced above, was approved with a delayed effective date, until the <br /> Page 1 <br />
