IV. COMPLIANCE WITH COUNTY ORDINANCES <br /> The proposed zoning district, RE-1, would allow golf courses not lighted for night-time use as a <br /> permitted use. A conditional use permit would be required for night-time operation. The <br /> County's Shoreland Zoning Ordinance (Chapter 11, Dane County Code) would apply within 300 <br /> feet of the intermittent stream. Any buildings or structures constructed would have to be a <br /> minimum of 75 feet from the stream's ordinary high water mark. Restrictions on removal of <br /> vegetation would also apply. <br /> V. COMPLIANCE WITH ADOPTED PLANS <br /> The town plans for both the Town of Montrose and the Town of Primrose designate this property <br /> as within an agricultural preservation area. While neither plan specifically addresses golf <br /> courses, both plans include protection of farm operations from incompatible, non-agricultural <br /> uses as a primary goal of their agricultural preservation areas. <br /> The Dane County Farmland Preservation Plan and Section 91.77 of the Wisconsin statutes <br /> require the county to make the following findings before rezoning land out of the A-1 <br /> (Exclusive) district: <br /> (a) Adequate public facilities to accommodate development either exist or will be provided <br /> within a reasonable time; <br /> (b) Provision of public facilities to accommodate development will not place an unreasonable <br /> burden on the ability of affected local units of government to provide them; <br /> (c) The land proposed for rezoning is suitable for development and development will not <br /> cause unreasonable soil erosion or have an unreasonably.adverse effect on rare or irreplaceable <br /> natural areas. <br /> VI. PUBLIC, LOCAL GOVERNMENT, AND AGENCY INPUT <br /> At the time of this writing, no other county agencies had commented on this proposal. <br /> The Town Board of Montrose voted 3-0 on April 7, 1998 to recommend approval with the <br /> following conditions: <br /> 1. The property be deed restricted to a golf course, and; <br /> 2. A performance bond be issued for Argue Road. <br /> The applicant has indicated that the Town of Primrose has recommended denial of the <br /> application. but the Department of Planning and Development has not yet received a Town <br /> Action Report. <br /> VII. SITE AND NEIGHBORHOOD PLANNING ISSUES <br /> A site plan was not submitted as part of this application, and it is impossible to determine the full <br /> impact of this proposal without more detailed information.
