MAR 23 '98 03:10PM TOWN OF WESTPORT P.4/21 <br /> TOWN OF WESTPORT • <br /> RECOMMENDATION BY THE TOWN OF WESTPORT <br /> BOARD OF SUPERVISORS TO DANE COUNTY REGARDING THE <br /> CONDITIONAL USE PERMIT APPLICATION FOR THE <br /> MADISON COUNTRY DAY SCHOOL DEVELOPMENT <br /> WITHIN THE TOWN OF WESTPORT, DANE COUNTY, WISCONSIN <br /> WHEREAS, application for approval of a Conditional Use Permit ("CUP # 1415") <br /> for an area of land located in the Town of Westport (the "Town") as shown on the map <br /> attached as Exhibit A, was submitted by the Madison Country Day School ("Petitioner") <br /> o Dane County for approval, and pursuant to Dane County Ordinances, to the Town for <br /> review and comment; and, <br /> WHEREAS, CUP#1415 was referred to the Town Plan Commission for its review <br /> and its recommendation to the Town Board; and, <br /> WHEREAS, the Plan Commission and Town Board have reviewed CUP#1415 and <br /> net with legal counsel and with Petitioner and its various representatives with respect to <br /> CUP #1415 at several open meetings; and, <br /> WHEREAS, CUP #1415 requests approval for the use of approximately 46 acres <br /> of property in an area zoned A-1 EX (Agriculture Exclusive) as a private school; and <br /> WHEREAS, the CUP #1415 property is within an area designated as part of the <br /> Agricultural Preservation District under the Town's Land Use Plan; and <br /> WHEREAS, the Plan Commission, at a joint meeting with the Town of Westport <br /> Board of Supervisors held on April 10, 1997, after further public input and consideration <br /> at that meeting, has reconsidered a previous recommendation and now determined that <br /> CUP #1415 will only be consistent with the Town of Westport Land Use Plan, and only <br /> meet the Dane County Zoning Code standards to allow the conditional use requested, if <br /> certain conditions, as noted below, are imposed on the development of the parcel and met; <br /> and <br /> .WHEREAS, the Plan Commission is in the process of updating the Town's Land <br /> Use Plan, and in particular is working on revising the Plan based on discussions it will <br /> be having with the owner of the parcel for which CUP #1415 was requested, who also <br /> n.wir soo611471CLIPREC.row <br /> 0414971549 1 • <br />
