• DANE COUNTY ORDINANCE AMENDMENT NO. 7174 Amending Section 10.03 relating to Zoning Districts in the Town of Dunn. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Dunn be amended to include in the R-3A Residential District/s the following described land: PET11'1ON NUMBER: 7174 Part of the SE 1/4 NW 1/4 Section 19, Town of Dunn, described as follows: Lot 6, Block 3, Oregon Heights, in the Town of Dunn. Also, part of Outlot 1, Block 3, Oregon Heights, in the Town of Dunn, described as follows: Commencing at the Southeast corner of said Outlot 1; thence North 0°4'East 200 feet; thence West to the Westerly boundary of Outlot 1; thence Southerly along the lot line to the Southwest corner of Outlot 1; thence Easterly along the lot line of Outlot 1, to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. CERI'IHED SURVEY REQUIRED The above listed description's is/are intended to describe land for which a certified survey map will be prepared for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the recorded survey shall be submitted to Dane County Zoning. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1.That the portion of the lot on White Oak Trail shall be used only for the sanitary system. Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. tZ\ 0\\067 The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be consistent with the provisions of Wisconsin State Statute 91.77 (1)(a),(b),(c).
