DANE COUNTY ORDINANCE AMENDMENT NO. 7189 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Westport. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Westport be amended to include in the C-1 Commercial District/s <br /> the following described land: <br /> PETITION NUMBER/C.U.P. NUMBER: 7189/1490 <br /> A parcel of land located in the SE 1/4 of the SW 1/4 of Section 22, T8N, R9E, Town of <br /> Westport,Dane County, Wisconsin, more fully described as follows: Commencing at the <br /> S 1/4 corner of said Section 22; thence N 89°00'31"W, 1331.45 feet; thence N <br /> 2°33'48"E, 885.21 feet to a point on the southerly right-of-way line of CTH M; thence N <br /> 75°45'00"E along the said right-of-way line of CTH M, 679.92 feet to the point of <br /> beginning; thence continuing N 75°45'00"E along the said right-of-way line 240.00 feet; <br /> thence S 14°16'00"E, 187.00 feet to the centerline of Willow Road; thence $ 41°29'00" <br /> W along the said centerline, 28.07 feet; thence S 45°34'16"W along the said centerline <br /> 61.18 feet; thence N 44°25'44"W, 33.00 feet to a point on the northerly right-of-way line <br /> of Willow Road, said point being a point of curvature of a curve to the left, having a <br /> radius of 718.00 feet, a central angle of 14°19'54", a chord bearing of N 69°36'48"W, <br /> and a chord distance of 179.13 feet; thence along the arc of said curve 179.60 feet to a <br /> point of tangency thereof;thence N 14°15'00"W, 103.22 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions: <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.All applicable conditions contained in Resolution#98-6 for CUP# 1479. <br /> 2.Deed Restriction to allow only convenience store,car wash,and dispensing of gasoline. <br /> 3. Water line to be extended from Bluebill Park Dr. west along CTH "M" to west end of the <br /> property with developers recapture agreement. <br /> 4.Design review approval. <br /> 5. Approved plan for keeping ice from public roads in winter. <br /> 6.Delayed effective date. <br /> 7.No outside storage. <br /> 8. Landscaping consistent with previous plan and further design review to be approved by the <br /> town. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners <br /> of land within 300 feet of the site.Failure to record the restrictions will cau the rezone to be null <br /> and void. <br /> pL*, <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
