February 28, 1998 <br /> Mr.John Sales <br /> Land Use Committee <br /> Town of Montrose <br /> 6555 Purcell Road <br /> Belleville, WI <br /> Dear John: <br /> Attached you will find a modified request for rezoning the property at the corner of Paoli and Speedway <br /> Roads that went before the Town of Montrose Land Use Committee on February 23, 1998. The <br /> modification corrects the technical error we made in our original request. The original proposal asked that <br /> a 1 acre portion of the A-1 Exclusive portion of this parcel be rezoned to RH-1. Unfortunately county <br /> zoning regulations require that RH-1 parcels be at least 2 acres. On the other hand, R-1A parcels can be as <br /> small as 1/2 acre. Because R-1 A restrictions on land use are even more restrictive than those called for in <br /> RH-1, we are in effect asking for less than the Montrose Land Use Committee approved in the meeting on <br /> February 23. <br /> We are asking that the Town of Montrose Board approve the resolution adopted by the Land Use <br /> Committee on February 23,modified to correct the technical error in the original request. <br /> You've told me there is some sentiment on the board favoring the alternative we submitted to the Land Use <br /> Committee on February 23. The alternative asked for a rezoning of the parcel to A-2 and a 2 acre portion <br /> to RH-1. The committee considered approving this proposal subject to deed restrictions limiting the A-2 <br /> portion to A-1 Exclusive use. Unfortunately,we are facing a March 2 deadline for application to Dane <br /> County Zoning,a date one day before the Board meeting. To submit the application,we are required to <br /> provide a meets and bounds description of the residential parcel to be rezoned. The combination of the fee <br /> for the zoning request and the survey work is approximately$350. We are submitting our application <br /> based on the resolution approved by the Land Use Committee. Should the Town of Montrose Board revert <br /> to our alternative request,our request will be delayed an additional 30 days at the county level and we will <br /> be forced to re-incur the application fee and redo the survey work. It is my hope that you will support the <br /> modified version of the attached request at the Board Meeting on March 3. <br /> The Land Use Committee also expressed a desire in the resolution passed on February 23 that we work out <br /> a long-term arrangement with the Salsiburys allowing supplemental use of the dirt road crossing the Statz <br /> property to their farm immediately to the North of the Statz property. I met with Brain and Marie Salisbury <br /> on the evening of Wednesday,February 23`d. We discussed terms that we both seemed to consider to fairly <br /> allow supplementary and emergency access to their property while preserving my rights to the property I <br /> hope to purchase. Our attorneys talked Friday and my wife talked to Marie Friday afternoon. It is our hope <br /> that we'll have a written agreement by the March 3 Board Meeting. Of course this agreement will be <br /> contingent on the approval of rezoning and my purchase of the property. <br /> John,thanks again for the time you have put into working with me on this request.
