FOTI <br /> 5529 BOX ELDER ROAD <br /> MARSHALL, WI 53559 <br /> April 29, 1998 <br /> Last night, April 28, we had a hearing before the Dane County Zoning and Natural <br /> Resources Committee regarding our request to rezone 1. 5 acres to C-1 zoning. David and <br /> Brenda Gottschalk appeared before the Committee in opposition to this rezoning and <br /> presented a petition with 19 names on it indicating they were also in opposition to the <br /> rezoning. Based upon statements before this committee it is apparent that there is some <br /> confusion regarding our rezoning. <br /> Our intent is to establish a greenhouse business to sell bedding plants and other related <br /> items. We also intend to work land on the farm for the production of vegetables and <br /> flowers to primarily be sold off site(farmers markets, etc.). Enclosed is a preliminary lay <br /> out of the building we will eventually be constructing on this land. We have attempted to <br /> keep these buildings close to the existing structures and take out of production as little <br /> land as possible. <br /> The construction of these buildings is permitted under Al AG Exclusive Zoning. The <br /> reason we are rezoning to C-1 is that under Dane County Zoning the sale of related items <br /> such as prepackaged fertilizer or soil, pots or any other related item not produced by us is <br /> considered a retail function and thus commercial zoning is required. <br /> It was stated to the Committee that the proposed office use for my real estate appraisal <br /> business would be better located in the Village. Since last Summer I have attempted to <br /> locate adequate and reasonably priced office space in Marshall. In that time the only <br /> locations that have been available were the Sign Shop in Terry Hellenbrand's building <br /> which was filled rapidly with a new tenant. The small space next to the pharmacy, which <br /> is no bigger than the office I have now. And the dentist office building which is for sale <br /> at a price past our means. I even contacted Lee Hellenbrand to inquire whether he would <br /> have any office space above the diner. For this reason it became obvious that the best <br /> solution would be to locate my office at the same site since it had to be rezoned any way. <br /> This office will not create any traffic other than myself and my partner and no sign will <br /> be put up identifying its location. <br /> It was also stated that my attempt to rezone this parcel was an abuse of my power as <br /> Town Chairman.
