These two proposed non-residential sites appear to conflict with adopted <br /> town/county policies in the Town of Berry: <br /> No land division of less than 35 acres will be permitted in the agricultural district unless <br /> the following criteria are all met as follows: <br /> - Land where farming has not been economical in the past <br /> - Land parcels too small for practical agriculture activities such as <br /> accessibility for farm machinery. <br /> - Land which does not require the development of a public road, and fronts or <br /> abuts a public road <br /> - Land which has less productive soils than "prime"or "statewide <br /> significance"as delineated on the soil maps <br /> - Land where development would not destroy wetlands, and steep slopes. <br /> Staff Comments on Criteria: <br /> 1. Most of this land (80% according to the application) is cropland. <br /> 2. These two parcels comprise 63 acres, thus they are not small parcels. <br /> 3. These parcels do abut public roads. The northern parcel could access Jacoby Road and avoid <br /> direct access of STH 19, while the southern parcel would have to provide direct access onto <br /> STH 19. <br /> 4. The site is mostly "prime" farmland by USDA definition, and the area which is not "prime" <br /> farmland is wetland and floodplain of the Halfway Prairie Creek. Wetland/floodplain areas do <br /> not allow for residential development. <br /> 5. Such development would not necessarily destroy the wetlands, but would require careful <br /> construction and erosion control to protect the wetlands and the creek. <br /> NOTE: All policy criteria are to be met. It appears that this proposal conflicts with three of the five <br /> stated criteria. <br /> The adopted plan allows for a nonfarm residential density of one lot per 35 acres, and allows for <br /> fractions, thus the 63-acre ownership would allow for two nonfarm residential sites. <br /> The adopted plan also states: "The minimum lot size shall be between two and ten acres." These <br /> large sites are clearly inconsistent with this policy as stated. <br /> We have been informed that the Town of Berry has amended this policy; however, the text of that <br /> amendment has not been submitted for county review and amendment as part of the county adopted <br /> plan. <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> DANE COUNTY HIGHWAY <br />
