DANE COUNTY ORDINANCE AMENDMENT NO. 7199 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Berry. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Berry be amended to include in the A-2 Agricultural District/s the <br /> following described land: <br /> PETITION NUMBER: 7199 <br /> A part of the SW 1/4 of the SE 1/4 of Section 5, and part of the NW 1/4 of the NE 1/4 of <br /> Section 8, Town of Berry described as follows: <br /> TO A-2: Beginning at the Northeast corner of the NW 1/4 of the NE 1/4; thence <br /> Southerly along the 40 line to the centerline of Halfway Prairie Creek; thence <br /> Southwesterly along said centerline to the Northerly right-of-way of State Highway 19; <br /> thence Westerly along said right-of-way to a point on the Easterly right-of-way of Jacoby <br /> Drive;thence Northerly along said right-of-way to a point which is 585.8 feet South of the <br /> North line of Section 8; thence East to a point which is 181.5 feet East of the West line of <br /> the NW 1/4 of the NE 1/4; thence Northerly to the North of said Section 8; thence <br /> Easterly along said North line to the point of beginning. Together with the East 1138.5 <br /> feet of the South 124.35 feet of the SW 1/4 of the SE 1/4 of said Section 5. <br /> A part of the SW 1/4 of the NE 1/4 of Section 8, Town of Berry described as follows: <br /> ALSO: Beginning at the Southeast corner of of the SW 1/4 of the NE 1/4; thence <br /> Westerly along the East-West quarter line to the Southeast corner of CSM#2229; thence <br /> along the East line of said CSM N10°12'45" East 1201.32 feet to the Northeast corner <br /> thereof said point of being on the Southerly right-of-way of STH 19; thence Easterly <br /> along said right-of-way to a point on the East line of said SW 1/4 of the NE 1/4; thence <br /> Southerly along said East line to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.Prohibit further residential development on parcels 0807-0801-9000,0807-081-8500,and 0807-054- <br /> 9370;carried 6-0. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site.Failure to record the restrictions will cause the rezone to be null and <br /> void. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
